17.44.010 - Permit—Required—Exceptions.¶
No person shall make or construct any excavation in the city without first having received a permit to do so from the city engineer; provided, however, that this section shall not apply to excavations for foundations for, or cellars under, buildings or structures, or for the laying of pipes for sewers, gas or water, electric wires or cables; the granting of permits for which are provided for in other provisions of this code.

17.44.020 - Permit—Refusal.¶
The city engineer may refuse to grant any permit for an excavation provided for in Section 17.44.010, where such excavation may result in the creation of a hazard to public peace, health or safety, or may create or constitute a public nuisance.
