Sec. 20.412.005 - Intent.

This combining district allows for the grouping of dwellings on a single parcel in suitable areas for the purposes of enhancing and protecting the natural resources of a site while providing a buffer to adjacent resource lands. The CL Combining District is intended to be used only in conjunction with lands designated RL, FL, AG, RMR and RR:L-10.

Sec. 20.412.010 - Coastal Development Use Permit Required for CL Combining Districts.

A coastal development use permit shall be required for a cluster development and shall be subject to the following provisions:

(A) The proposed development is consistent with the provisions set forth in this Division.

(B) At least seventy-five (75) percent of the project area will remain in open space.

(C) The open space area from which density or development was transferred shall be protected from future division by means such as contracts with the County, coupled with deed restriction, conservation easement, open space conservation agreement, or other appropriate legal mechanisms. Such contracts, easements, or agreements shall contain language which will be recorded in a manner that insures the long-term protection of the resources.

(D) The proposed project is compatible with adjacent agricultural, range or forest uses and will not interfere with accepted management practices on these lands.

(E) The proposed clusters will not inhibit resource management of the remaining open space, are near existing access routes and are not in hazard areas.

(F) The proposed cluster development will be served adequately by essential public facilities and services such as highways, streets, police and fire protection and schools where applicable.

(G) Site disturbance will be minimized by clustering, road location along contours and building site selection.

(H) All applicable development standards in this Division can be met.

(I) The proposed clustering utilizes less prime land than would dispersed development.

Sec. 20.412.015 - Parcel Size for CL Combining Districts.

As permitted in the zoning district combined with the "CL" designation with the following exception.

Sec. 20.412.020 - Maximum Dwelling Density for CL Combining Districts.

As allowed in the zoning district combined with the "CL" designation unless, as an incentive to clustering to conserve available resources, the County determines that a density increase of not more than ten (10) percent is appropriate. Any density increase shall be consistent with the conditions of this Division, health and safety regulations, and the availability of all required public services, where applicable, and shall result in a superior environmental design. In no instance may this density increase allowance be used in conjunction with the density bonus provided in Section 20.444.30.

Sec. 20.412.025 - Setbacks for CL Combining Districts.

Setback requirements may be reduced below that required in the base zoning district where it will result in a superior environmental design.

Sec. 20.412.030 - Fee Waiver for CL Combining Districts.

In order to promote clustering to conserve available resources and where it will result in superior environmental design the County Board of Supervisors may waive application fees. A fee waiver may not be granted where a density increase has been provided pursuant to Section 20.412.020.
