8-10.01 - Enclosures required for swimming pools and ponds.¶
Every person in possession of land within the City, either as owner, purchaser under contract, lessee, tenant, or licensee, upon which land a swimming pool or any other artificially created body of water, any portion of which is eighteen (18″) inches or more in depth, is situated, at all times shall maintain upon the lot or premises upon which such pool is located a fence or other solid structure not less than six (6′) feet in height with no opening therein, other than doors or gates, larger than six (6″) inches square, and such fence or solid structure shall surround completely such pool or body of water, lot, or premises so that access thereto may be made only through such fence or structure. A dwelling, accessory building, or other similar structure may be used as part of such enclosure. All gates or doors opening through such fence or structure shall completely fill an opening in such a fence or structure in excess of six (6″) inches square, and shall be kept closed securely at all times when not in actual use, and shall be equipped with a self-closing, self-latching device not less than four (4′) feet above grade and capable of keeping such door or gate securely closed and latched at all times when not in actual use; provided, however, the door of any dwelling which forms a part of the enclosure hereinabove required need not be so closed or equipped.

8-10.02 - Compliance requirements.¶
All plans for the construction of a swimming pool or other artificial body of water described in Section 8-10.01 of this chapter hereafter submitted shall show compliance with said Section 8-10.01, and no permit to construct such pool or body of water shall be issued until such plans show compliance. Final inspection and approval of all swimming pools or other artificial bodies of water hereafter constructed shall be withheld until there has been compliance with all the requirements of Section 8-10.01 of this chapter.

8-10.03 - Exceptions.¶
The provisions of Section 8-10.01 of this chapter shall not apply to swimming pools for which a charge or admission price is required to be paid for the use thereof, nor to swimming pools or other bodies of water which are a part of, and located upon the same premises as, a hotel or motel during the time the owner, operator, or adult employee of such owner or operator is present at, and in active charge of, the premises upon which such pool is located. The provisions of said Section 8.10.01 shall not apply to any swimming pool which at all times is filled with water and is protected by a pool cover or other protective device approved by the City.
