24.30.010 - Procedure.

Any person aggrieved by a determination, interpretation, decision, conclusion, decree, judgment or similar action relative to this title and under the jurisdiction of the agency may appeal such action to the board of supervisors. If the action was taken by an administrative person of the community development agency, the appeal shall be to the planning commission as provided in Chapter 22.89.

24.30.020 - Filing.

(a)

Appeals shall be addressed to the board of supervisors in writing and shall state the basis of the appeal. Appeals shall be filed with the clerk of the board not later than five p.m. of the fifth working day following the date of action from which the appeal is taken. Appeals shall be accompanied by the filing fee in the amount specified in the board of supervisors' resolution establishing fees for petitions.

(b)

In the event that any work has been undertaken without legal authority prior to completing the requisite procedures necessary to authorize such work, the applicant shall pay double the permit fees.

24.30.030 - Notice of hearing.

At least ten days prior to the hearing, a public notice of the appeal shall be mailed to all persons whose names and addresses are shown on the latest equalized assessment roll of the county as owners of real property within a distance of three hundred feet of the property which is the subject of the appeal. The notice must include the date, time, and place of the hearing, the identity of the hearing body or officer, and a general location and description of the appeal to be considered. In addition, the notice shall either be published in at least one local newspaper of general circulation at least ten days prior to the hearing, or posted in at least three local public places in the area of the property which is the subject of the appeal.

24.30.040 - Time limit—Vote.

The board of supervisors shall act on an appeal no later than the fourth regular meeting following the date on which the appeal was filed unless a time extension is agreed to between the board and the appellant. The action from which an appeal is taken may be reversed or modified only upon an affirmative vote of a majority of the authorized member-ship of the board.

24.30.050 - Failure of board to act.

Failure of the board of supervisors to act within the time specified shall sustain the action being appealed.

24.30.060 - Board of supervisor's action.

Notwithstanding any provision of this chapter, any matter which must ultimately be decided and/or enacted by the board of supervisors shall not be subject to the right of appeal set forth herein.
