9.100.010 - Violations.

A. Any violation of this Title 9 is unlawful, and no person shall erect, construct, alter, or repair any building or structure in any manner that does not comply with this Title 9 or any construction document, permit, directive, certificate, or order approved or issued by the City pursuant to this Title 9.

B. No person shall willfully resist, delay, obstruct, or interfere in any way with the Building Official or his or her authorized representative in the discharge, or attempt to discharge, of any official duty under this Title 9.

9.100.020 - Criminal and civil penalties; public nuisance.

A. Violations of this Title 9 are subject to criminal misdemeanor penalties and administrative citation fines and penalties pursuant to Municipal Code Chapters 1.04 and 1.06, respectively. At the discretion of the City Prosecutor, a violation of this Chapter may be prosecuted as an infraction or misdemeanor.

B. Violations of this Title 9 are hereby declared a public nuisance and may be abated by the City through civil process by means of restraining order, preliminary or permanent injunction, or in any other manner provided by law for the abatement of such nuisances.

C. In any civil action brought under this Chapter 9.100, a court of competent jurisdiction may award reasonable attorneys' fees and costs to the prevailing party.
