2.58.010. - Adoption.¶
The Town Council hereby adopts a military equipment policy which shall govern the use of military equipment by the Town Police Department, designated as Policy 706 of the Town Police Department Policy Manual. Policy 706 is also incorporated in this section by reference. Copies of the policy are on file in the office of the Town Police Chief and the Town Clerk.

2.58.020. - Findings and determinations.¶
Pursuant to Government Code § 7071(d), the Town Council finds and determines, with respect to Policy 706 (Military Equipment Funding, Acquisition, and Use Policy) that:
(1) The military equipment listed in the table in the policy is necessary because there is no reasonable alternative that can achieve the same objective of officer and civilian safety.
(2) The policy will safeguard the public's welfare, safety, civil rights, and civil liberties.
(3) When and if replacement items are purchased for the items of military equipment listed in the table in the policy, the equipment is reasonably cost effective compared to available alternatives that can achieve the same objective of officer and civilian safety.
(4) Prior use by the Town Police Department of items now classified as military equipment by Government Code § 7070 complied with the military equipment use policy that was in effect at the time.

2.58.030. - Review.¶
Pursuant to Government Code § 7071(e), Town staff are directed to bring this chapter to the Town Council for review at least annually so that the Town Council may vote on whether to renew the provisions and determine whether each type of military equipment has complied with the standards of approval set forth herein and in Government Code § 7071(d).
