2.40.010. - Adoption.¶
In order to establish an equitable and uniform system for dealing with personnel matters, and to comply with applicable laws relating to the administration of the personnel process, the personnel system pursuant to this chapter is adopted.

2.40.020. - Definitions.¶
The terms used to administer the personnel system shall be defined in the personnel rules.

2.40.030. - Administration.¶
The Town Manager shall administer the Town personnel system and may delegate any of the powers and duties to any other officer or employee of the Town. The Town Manager shall:
(1) Act as the appointing authority for the Town;
(2) Administer all the provisions of this chapter and of the personnel rules;
(3) Prepare and recommend to the Town Council personnel rules and revisions and amendments to such rules;
(4) Prepare or cause to be prepared a position classification plan, including class specifications, and revisions to the plan;
(5) Have the authority to discipline employees in accordance with this chapter and the personnel rules of the Town;
(6) Provide for the publishing and posting of notices for positions; the receiving of applications therefor; the conducting of interviews and performing any other duty that may be required to administer the personnel system.

2.40.040. - Applicability of provisions.¶
(a) The provisions of this chapter shall apply to all offices, positions, and employments in the competitive service of the Town, except:
(1) Elected officers;
(2) The Town Manager;
(3) The Town Attorney and any assistant Town attorneys;
(4) Department heads with individual employment contracts;
(5) Appointed members of boards, commissions, and committees;
(6) Persons engaged under contract to supply expert, professional, technical, or any other services;
(7) All Council-appointed Town officers;
(8) Emergency employees who are hired to meet the immediate requirements of an emergency condition, such as fire, flood, earthquake, or extreme weather event which threatens life or property;
(9) Limited term employees, which are not provided full-time employment throughout the fiscal year. The kinds of positions assigned to limited term include temporary, part-time, seasonal positions, or positions hired due to an emergency;
(10) At-will employees with individual employment contracts.
(b) Nothing in the personnel rules adopted pursuant to this chapter shall preclude the layoff of an employee holding any position primarily funded under a State or Federal employment program or grant when such program or grant ends or expires.

2.40.050. - Amendment of rules.¶
Personnel rules shall be adopted by resolution of the Town Council.
