Chapter 17.08 — DEFINITIONS

17.08.001 - Abut.

"Abut" means to physically touch, border upon, or to share a common corner or property line. For the purposes of this title, abutting properties shall include those properties separated by any road, street or highway, except a limited access major highway.

17.08.002 - Approved access.

"Approved access" means access to a public street or highway, improved or unimproved.

17.08.003 - Access road.

"Access road" means a way or means of approach to provide vehicular ingress and egress to a property.

17.08.004 - Acre.

"Acre" means a measure of land containing forty-three thousand five hundred sixty net square feet.

17.08.005 - Advisory agency.

"Advisory agency" means the planning commission for the purpose of tentative map and the parcel map committee, for the purpose of parcel maps, parcel map waivers and lot line adjustments.

17.08.006 - Aliquot.

"Aliquot" means the division or measurement of land in one-half or one-quarter portions.

17.08.007 - Alley.

"Alley" means a service way providing a secondary means of public access to abutting property and not intended for general traffic circulation.

17.08.008 - Authorized representative.

"Authorized representative" means any person who has been designated in writing by the subdivider as the person, firm or corporation to represent the subdivider.

17.08.009 - Arterial road.

"Arterial road" means an existing or planned road which will provide moderate volume connections between activity centers and connections from collectors to freeways, highways and expressways. Access from local roads and driveways should be minimized. Although an existing arterial road may have two lanes of through traffic, it is planned to have at least four through lanes in the future.

17.08.010 - Base flood.

"Base flood" means the flood possessing a one percent chance of being equaled or exceeded in any one given year (also called the one hundred-year flood).

17.08.011 - Bicycle trail/path/lane.

"Bicycle trail/path/lane" means a trail or path or lane designed primarily for the use of bicycles.

17.08.012 - Block length.

"Block length" means that distance as measured along rear property lines between intersecting streets (see illustration).

17.08.013 - Board of supervisors (board).

"Board of supervisors (board)" means the board of supervisors of the County of Madera.

17.08.014 - Bridge.

"Bridge" means a crossing over a watercourse, railway, freeway or canyon.

17.08.015 - Building.

"Building" means any permanent structure built or installed for the support, shelter or enclosure of persons, animals, chattel or property of any kind.

17.08.016 - Centerline, legal.

"Legal centerline" means a line designated by official survey to be the center of a future or existing fully developed easement, street, road or highway, which may or may not coincide with the construction centerline.

17.08.017 - Civil engineer.

"Civil engineer" means the person retained by a subdivider to process a subdivision or parcel map, and who shall be registered to practice civil engineering in the state of California.

17.08.018 - Collector road.

"Collector road" means an existing or planned road which will provide a low-volume connector between local and arterial roads. Access to other roadways is only restricted by design standards. Access to driveways should be minimized. Although an existing collector may have two lanes of through traffic, it is planned to have at least four through lanes in the future.

17.08.019 - Condominium.

"Condominium" means an estate in real property consisting of an undivided interest in common in a portion of a parcel of real property together with a separate interest in a space in a residential, industrial or commercial building on such real property.

17.08.020 - Construction.

"Construction" means design, acquisition of site or right-of-way, administration of construction contracts and actual construction.

17.08.021 - Contiguous.

"Contiguous" means to physically touch, border upon or to share a common corner or property line. For the purposes of this title, contiguous properties shall include those properties separated by any road, street or highway, except a limited access major highway.

17.08.022 - Conversion.

"Conversion" means the creation of separate ownership of existing real property together with a separate interest in space of residential, industrial or commercial buildings.

17.08.023 - County.

"County" means the county of Madera.

17.08.024 - County counsel.

"County counsel" means the legal counsel of the county of Madera.

17.08.025 - County surveyor.

"County surveyor" means the county surveyor of the county of Madera or his/her designated representative.

17.08.026 - Cul-de-sac street.

"Cul-de-sac street" means a street which is permanently closed at its termination with provision for a turning area for convenient reversing of vehicular traffic.

17.08.027 - Dead-end road.

A road that has only one point of vehicular ingress/egress, including cul-de-sacs, hammerhead T and looped roads.

17.08.028 - Dedication (or offer of dedication).

"Dedication (or offer of dedication)" means a conveyance of or offer to convey land to some public use, especially streets, made by the owner.

17.08.029 - Density.

"Density" means the number of dwelling units per specific area of land.

17.08.030 - Design.

"Design" means (1) street alignments, grades and widths; (2) drainage and sanitary facilities and utilities, including alignments and grades; (3) location and size of all required easements and rights-of-way; (4) fire roads and fire breaks; (5) lot size and configuration; (6) traffic access; (7) grading; (8) land to be dedicated for park or recreational purposes; and (9) other specific requirements in the plan and configuration of the entire subdivision as may be necessary or convenient to ensure conformity to or implementation of the general plan or any adopted specific plan.

17.08.031 - Development.

"Development" means the division of a parcel of land into two or more parcels; the construction, reconstruction, conversion, structural alteration, relocation or enlargement of any structure; any mining, excavation, landfill or land disturbance; and any use or extension of the use of land.

17.08.032 - Development standards.

"Development standards" means the minimum acceptable standards of design, materials and methods required to be used in improvement of subdivisions and other developments, as adopted and amended by the board of supervisors from time to time, in the manner provided by law.

17.08.033 - Development variation.

"Development variation" means a deviation, modification, deferral, or deletion of any improvement requirement specified this title.

17.08.034 - Driveway.

A vehicular access that serves no more than two buildings, with no more than three dwelling units on a single parcel, and any number of accessory buildings.

17.08.035 - Dwelling unit.

Any building or portion thereof, which contains living facilities, including provisions for sleeping, eating, cooking and/or sanitation for not more than one family.

17.08.036 - Easement.

"Easement" means a grant of one or more of the property rights by the owner to or for the use by the public, a corporation, or another person or entity.

17.08.037 - Engineering department.

"Engineering department" means the engineering and survey services department of the county of Madera, including the county's surveyor's office.

17.08.038 - Environmental document.

"Environmental document" means documents prepared under the California Environmental Quality Act, including initial studies, negative declarations, draft and final environmental impact reports (EIR), documents prepared as substitutes for EIRs and negative declarations under a program certified pursuant to California Public Resources Code Section 21080.5, and documents prepared under National Environmental Policy Act and used by a state or local agency in the place of an initial study, negative declaration or an EIR.

17.08.039 - Expressway.

"Expressway" means an existing or planned road which will provide for intra-county or inter-city trips. Although an expressway may have as few as two lanes of through traffic, it could have as many as six lanes of through traffic. Access is limited in accordance with design standards.

17.08.040 - Fence (or wall).

"Fence (or wall)" means an artificially constructed barrier of any material or combination of materials erected to enclose or screen areas of land.

17.08.041 - Fire marshal.

"Fire marshal" means the fire marshal's office or the department of fire prevention for development or his/her designated representative.

17.08.042 - Fire protection facilities.

"Fire protection facilities" means facilities including, but not limited to, water supply for firefighting purposes, fuel breaks, emergency access roads, and an offer of dedication of a site.

17.08.043 - Final map.

"Final map" means a map prepared in accordance with the provisions of the Subdivision Map Act and this title, which map is designed to be placed on record in the office of the county recorder.

17.08.044 - Freeway.

"Freeway" means an existing or planned road which will provide for inter and intra region mobility. This is a high volume, high speed road with extremely limited access in accordance with design standards.

17.08.045 - Flood or flooding.

"Flood" or "flooding" means a general and temporary condition of partial or complete inundation of normally dry land areas from (1) the overflow of floodwaters; (2) the unusual and rapid accumulation or runoff of surface waters from any source; and/or (3) the collapse or subsidence of land along the shore of a lake or other body of water as a result of erosion or undermining caused by waves or currents of water exceeding anticipated cyclical levels or suddenly caused by an unusually high water level in a natural body of water, accompanied by a severe storm or by an unanticipated force of nature or by a similarly unusual and unforeseeable event which results in flooding as defined in this definition.

17.08.046 - Flood boundary floodway map (FBFM).

"Flood boundary floodway map (FBFM)" means the official map on which the Federal Emergency Management Agency or Federal Insurance Administration has delineated both the areas of flood hazard and the floodway.

17.08.047 - Flood insurance rate map (FIRM).

"Flood insurance rate map (FIRM)" means the official map on which the Federal Emergency Management Agency or Federal Insurance Administration has delineated both the areas of special flood hazards and the risk premium zones applicable to the community.

17.08.048 - Floodplain.

"Floodplain means any land susceptible to being inundated by water from any source.

17.08.049 - Floodway or designated floodway.

"Floodway" or "designated floodway" means the channel of river or other watercourse and the adjacent land areas that must be reserved in order to discharge the base flood without cumulatively increasing the water surface elevation more than one foot or increasing the velocity to greater than seven feet per second, whichever results in the widest floodway. The floodway is delineated on the flood boundary floodway map

and the State Reclamation Board Designated Floodway Map. Floodways are also delineated on the official zoning maps as floodplain primary (FPP) district.

17.08.050 - Frontage road.

"Frontage road" means a street which is parallel and adjacent to a major street, limited-access highway or freeway, and which is designed to provide access to abutting properties.

17.08.051 - General plan.

"General plan" means the general plan of the county of Madera adopted by the board of supervisors pursuant to the California Government Code Sections 65300 et seq.

17.08.052 - Hammerhead T.

A roadway that provides a "T" shaped three-point turnaround space for vehicular traffic, including emergency equipment being no narrower than the road that serves it.

17.08.053 - Highway.

"Highway" means an existing or planned road which will provide for long distance trips with lower demand than a freeway. Volume and speed are lower than a freeway and access is limited in accordance with design standards.

17.08.054 - Improvement.

"Improvement" means and includes, but is not limited to, streets, storm drainage facilities, water systems, sewage systems and landscaping to be installed, or agreed to be installed, by the subdivider on the land to be used for public or private streets, highways and easements, as are necessary for the general use of the lot owners in the subdivision and local neighborhood traffic and drainage needs as a condition precedent to the approval and acceptance of the final map. Other specific improvements or type of improvements, the installation of which, either by the subdivider or by a combination of the subdivider, public agencies, private utilities, or any other entity approved by the county, is necessary or convenient to ensure conformity to, or implementation of, the general plan or any adopted specific plan. Improvements shall be constructed in accordance with the Madera County development standards.

17.08.055 - Land use.

"Land use" means a description of how land is used or proposed to be used.

17.08.056 - Limited design variation.

"Limited design variation" means permission to depart from the design requirements specified in the development standards and/or where specifically provided for in this title.

17.08.057 - Limited exception.

"Limited exception" means permission to depart from specific requirements of the development standards, granted by the director of the engineering department, where a deviation to the design standard is specifically referenced as a limited exception in the development standards.

17.08.058 - Local road.

"Local road" means a street which provides direct access to parcels or lots. Access from a local road is only restricted by design standards.

17.08.059 - Lot.

"Lot" means a parcel or portion of land separated from other parcels or portions, exclusive of public on private streets or alleys occupied or intended to be occupied by a main building or group of such buildings and accessory building, together with such open spaces, yards, minimum width and area as are required by this title or any other ordinance of the county, and having frontage on a road, public or private, approved by the county. A lot is not restricted to a parcel of land identified by lot number on a filed and recorded subdivision. No application for a building or use permit shall be considered by the county for any lot created in violation of this section.

17.08.060 - Lot frontage.

The length of the front lot line measured at the street right-of-way. On a corner lot, the frontage shall be the lesser of the two frontages.

17.08.061 - Lot, interior.

"Interior lot" means a lot abutting one street that forms an interior angle of one hundred thirty-five degrees or more.

17.08.062 - Lot line adjustment.

"Lot line adjustment" means a change in any lot line involving four or fewer existing adjoining parcels, whereby land taken from one parcel is added to an adjacent parcel, and where a greater number of parcels than originally existed is not thereby created.

17.08.063 - Lot width.

"Lot width" means the distance measured parallel to the street between the side lot lines in the event of a corner lot, the lesser dimension (see illustration).

17.08.064 - Map.

"Map" means a tentative map or a final map, as indicated by the context.

17.08.065 - Merger.

"Merger" means the combining of two or more contiguous parcels of land under one ownership into fewer parcels.

17.08.066 - Minor land division.

"Minor land division" means a subdivision which creates four or fewer parcels, not including a parcel specified as a designated remainder as authorized in Section 66424.6 of the State Subdivision Map Act (also see parcel map).

17.08.067 - Occupancy or occupied.

"Occupancy or occupied" means the residing of an individual or individuals overnight in a dwelling unit, or the installation, storage or use of equipment, merchandise or machinery in any public, commercial or industrial building.

17.08.068 - Off site.

"Off site" means located outside the lot in question.

17.08.069 - Official plan line.

"Official plan line" means the future right-of-way of any road or highway as adopted by resolution of the board of supervisors.

17.08.070 - Open space.

"Open space" means any parcel or area of land or water which is essentially unimproved and devoted to one or more of the following uses: preservation of natural resources, outdoor recreation or public health and safety.

17.08.071 - Owner.

"Owner" means the person, firm, association, syndicate, co-partnership, corporation or other legal entity having sufficient proprietary interest in the land sought to be subdivided to commence and maintain proceedings to subdivide the same under the Subdivision Map Act and this title, whether acting in the capacity of a joint owner, co-owner, guardian, executor, administrator or other person holding property in trust, and whether in person or by subdividers, agents, representatives or otherwise.

17.08.072 - Pad.

"Pad" means a building site prepared by artificial means.

17.08.073 - Parcel.

"Parcel" means a contiguous quantity of land in the possession of or owned by or recorded as the property of the same claimant or person.

17.08.074 - Parcel map.

A "parcel map" means a map filed under the provisions of the Subdivision Map Act (California Government Code Division 2, Chapter 2, Article 3, (Parcel Maps)).

17.08.075 - Park.

"Park" means public or private land used for active or passive recreation.

17.08.076 - Pedestrian way.

"Pedestrian way" means a walkway designed for use by pedestrians, which shall not be used by motor vehicles and which is not located within a street right-of-way.

17.08.077 - Permit.

"Permit" means written governmental permission issued by an authorized official or board of supervisors empowering the holder thereof to do some act not forbidden by law but not allowed without such authorization.

17.08.078 - Person.

"Person" means any natural person, firm, association, partnership, trustee, corporation or other legal entity in which title to real property may vest.

17.08.079 - Planning commission.

"Planning commission" ("commission") means the planning commission of the county of Madera.

17.08.080 - Planning director.

"Planning director" means the planning director of the county of Madera or his/her designated representative.

17.08.081 - Preliminary map.

A "preliminary map" means a map of a preliminary subdivision design submitted for pre-application review with the subdivision review committee and is not a formal tentative map application. The filing of the preliminary map is not an application for a development project as defined by the government code and not subject to the time limits pursuant to Section 65943 of said code.

17.08.082 - Property line.

"Property line" means a line or record that divides one lot or parcel from another lot or parcel or from a public or private street or any other public space.

17.08.083 - Public hearing.

"Public hearing" means a meeting announced and advertised in advance and open to the public with the public given an opportunity to present evidence and testimony.

17.08.084 - Public ways.

"Public ways" means all streets, roads, highways, avenues, boulevards, drives, conduits, parking areas, ways, esplanades, easements, rights-of-way, tunnels, culverts, wires, pipes, lines, tubes and any and all other property rights or interests, facilities or improvements therein or thereon, owned, possessed, held or under the control of political subdivisions and public or private utility entities.

17.08.085 - Right-of-way.

"Right-of-way" means a strip of land acquired by reservation, dedication, prescription or condemnation, and intended to be occupied by a road, crosswalk, pedestrian or bicycle path, railroad, electric transmission lines, oil or gas pipeline, water line, sanitary storm sewer, or other similar uses.

17.08.086 - Roads department.

"Roads department" means the roads department of the county of Madera, including the road commissioner.

17.08.087 - Road improvements.

"Road improvements" means road construction and related appurtenances agreed to be constructed or installed by the subdivider within existing or future public or private rights-of-way and easements for the general use of lot owners in the subdivision, as a condition to the approval and acceptance of the final map. Said road improvements shall include grading, paving, curbs and gutters, sidewalks, road name signs, local or road drainage facilities, guardrails, barricades, safety devices, retaining walls and such other facilities as are determined necessary by the county road commissioner or his designee.

17.08.088 - Roads, streets, private lanes.

Vehicular access to more than one parcel; access to industrial or commercial occupancy, or vehicular access to a single parcel with more than two buildings or four or more dwelling units.

"Sidewalk" means a paved, surfaced or leveled area, paralleling and usually separated from the street, used as a pedestrian walkway.

"Soils report" means data regarding the nature, distribution and strength of existing soils and their suitability to adequately accommodate a proposed subdivision. Such report also contains conclusions and recommendations and is prepared by a person authorized to prepare such a report in the state of California.

"Specific plan" means a plan prepared and adopted pursuant to Section 65450 et seq. of the California Government Code.

"Specific plan line" means the designated centerline of any road or highway as adopted by resolution of the board of supervisors from which the ultimate right-of-way is determined in accordance with the circulation element of the general plan.

"Cul-de-sac street" means a street with a single common ingress and egress and with a turnaround or loop at the end.

17.08.094 - Street, future.

"Future street" means an area dedicated on the final map for use as a street at a future time, and which is not required to be improved by the subdivider. A future street shall not be considered as part of any lot in application of zoning or setback regulations. The form of dedication of a future street shall be such as to keep it free and clear of any permanent structure.

"Use" means the purpose or activity for which land or buildings are designed, arranged or intended, or for which either is or may be occupied or maintained.

17.08.108 - Utility improvements.

"Utility improvements" means improvements agreed to be constructed or installed by the subdivider within existing or future public or private rights-of-way, easements or lots, for the general use of lot owners in the subdivision, and as are necessary for local neighborhood sanitation, water, communication and drainage needs as a condition to the approval and acceptance of the final map. The utility improvements shall include area drainage facilities, sanitary sewer and sewer systems, water mains, storage facilities and water systems, fire hydrants, street lights and street lighting systems, telephone service, cable television service, survey monuments, guardrails, barricades, safety devices, retaining walls, street trees, walls and fences to prevent access from private property to a street or highway as well as to provide screening between such property and such street or highway, and such other facilities as are determined necessary by the county for the appropriate development of the subdivision.

"Variation" means a development variation, and it means permission to depart from the literal requirements of the land division ordinance and development standards, previously known as a variance.
