Sec. 7.70. Sale of Personal Property of the City.¶
(a) Sale of Personal Property. Any personal property belonging to the City that is no longer required for the use of the City shall be sold by the General Manager of the Department of General Services, provided however, that no personal property that is under the control of any department of the City shall be sold except at the request in writing of the board, commission, or officer having the control and management of the department. The General Manager of the Department of General Services shall make all sales of personal property in the manner provided in this article.
(b) Salvaged Hazardous Electronic Equipment. Personal property of the City available for sale under this article does not include
salvaged City-owned hazardous electronic equipment covered by Section 7.82 of this article.

Sec. 7.71. Sale of Personal Property of the City.¶
(a) Any personal property belonging to the City that is no longer required for the use of the City may be sold under such terms and conditions, and under such procedure as the Council may by ordinance prescribe; provided, however, that no such personal property that is under the control of any department of the City government shall be sold except at the request or with the approval of the Board, Commission or officer having the management of such department. The proceeds of the sale of personal property shall be paid into the City treasury and placed in the fund of such department.
(b) Notwithstanding provisions of Subsection (a), or of Sections 7.72 through 7.76 of this Code, any personal property belonging to the City that is under the supervision and control of the Department of Water and Power, the Department of Airports, or the Harbor Department and which the Board of Commissioners of the Department finds and determines to be no longer necessary or suitable for use of that department, may be sold by the Board of the respective department, or by the Purchasing Agent if requested by said Board.
Before approving the method of disposition of specific personal property by sale as permitted herein, the Board shall also first determine that the manner of sale and the mode of payment is in the best interest of the City, and the Board shall adopt written findings in support thereof. Prior to entering into any sale which involves payment over a period in excess of 60 days, the Board shall make certain that the net present value of any deferred payments thereon will be at least equivalent to the net present value of a cash sale.
The sale maybe either a public sale after advertising for bids or a private sale, and may be a sale for cash, on credit, or upon consignment by the Board to an agent or consignee to effect the sale thereof, provided however, that if the sale involves property valued at, or property anticipated to result in a sale in excess of $1,000,000 and is a sale on credit, the sale shall be subject to prior Council approval by ordinance. Proceeds of any sale under authority of this subsection shall be paid into the City Treasury and placed in the fund of the department which previously had supervision and control of the property and had made the determination that it should be sold.

Sec. 7.72. Sale to Highest Bidder.¶
The Purchasing Agent shall issue requests for bids, and sale shall be made to the highest bidder; provided, however, if the Purchasing Agent deems it to be to the best interest of the City, the Purchasing Agent shall make such sale by a public auction or private sale. Every such sale shall be for cash, provided, however, said Purchasing Agent may in the Purchasing Agent’s discretion extend credit to any person, firm, or corporation purchasing personal property from the City, for a period not to exceed sixty days.

Sec. 7.73. Sales for Amounts in Excess of $1,000.¶
Before any sale of personal property involving an amount in excess of one thousand dollars ($1,000.00) is made, the sale shall be approved by the Purchasing Agent, and the head of the Department having control of such personal property, or in lieu of the latter, by the Director of the Office of Administrative and Research Services.

Sec. 7.74. Preparation of Invoices.¶
Whenever a sale is consummated, the Purchasing Agent shall issue invoices in quadruplicate, the original to be delivered to the person, firm, or corporation to whom the sale is made, the duplicate to the Department controlling such personal property, the triplicate to the City Controller, and the quadruplicate to remain on file in the office of the Purchasing Agent, who shall supervise and enforce the collection of such accounts.

Sec. 7.75. Payments Derived from Sale of Personal Property.¶
The Purchasing Agent shall receive all payments derived from the sale of personal property and shall deposit all such payments in the City Treasury to the credit of the fund of the department originally controlling the personal property sold.

Sec. 7.76. Disposition of Personal Property No Longer in Use.¶
(a) Any personal property belonging to the City, other than personal property under the control of the Department of Water and Power, the Harbor Department, and the Airports Department, no longer required for the use of the City department (or office, board commission, or other City agency) to which it has been assigned, shall be turned over to the Department of General Services. The property may be sold, provided the approval of the board, commission, or officer having the control and management of the department has been obtained, and the sale, whenever practicable, shall be to any department (or office, board commission, or other agency) of the City government.
(b) Personal property of the City available for sale under this article does not include any salvaged City-owned hazardous electronic equipment covered by Section 7.82 of this article.

Sec. 7.77. Transfer of Equipment.¶
The Purchasing Agent shall have the authority and right to transfer, by loan, from any department of the City government to any other department of the City government any article of furniture or equipment that is not in actual use by the department owning or having possession of the same, provided there is no immediate necessity for the department owning or having possession of the same to retain the equipment for immediate future use.

Sec. 7.78. Disposition of Obsolete or Worn Out Equipment.¶
(a) When any article of furniture or equipment owned by or in possession of any department of the City government becomes obsolete or worn out, the article shall be condemned and removed from service upon recommendation of the Purchasing Agent, approved by resolution of the City Council provided that no furniture or equipment shall be sold without the consent of the head of the department owning the equipment.
(b) Obsolete or worn-out equipment available for sale under this article does not include any salvaged City-owned hazardous electronic equipment covered by Section 7.82 of this article.

Sec. 7.79. Perpetual Stock Records.¶
Each department and office, except those departments given control of their own definite revenues or funds, to which furniture or equipment has been purchased for or assigned to by the City shall maintain a current and perpetual stock record of such furniture and equipment. The Controller shall prescribe the items of furniture and equipment to be contained in the records, information requirements on records, and the procedures for controlling furniture and equipment inventories. Department Heads shall certify to the best of their knowledge that their records are complete, correct and the equipment is in their official possession or under charge of their department. The Controller shall make such examinations of the perpetual stock records, summaries, or lists required by this section as deemed necessary.

Sec. 7.80. Automobile Certificates of Ownership (Pink Slip).¶
All commissions not having control over their own funds, and all department heads having under their jurisdiction automobiles owned by the City, shall deposit with the Purchasing Agent all pink slips showing ownership of automobiles owned by the City and under their supervision, and in the future, the Purchasing Agent shall receive and file all pink slips covering purchase of new automobiles or trucks. Said pink slips shall be in the custody of the Department of General Services.

Sec. 7.81. Use of DDT, DDD and Mercury-Based Fungicides.¶
There shall be no further acquisition, storage, or use by any City department of dichlorodiphenyltrichlorethane (DDT), dichlorodiphenyldi- chlorethane (DDD), or of mercury-based fungicides, and the head of each department which has any City-owned supplies thereof shall immediately cause said supplies to be disposed of at one of the Los Angeles County dumps certified for said purpose.
