Sec. 22.657. Services to Certain Entities.

The Department, upon written request, is authorized to provide Information Technology System services, to any of the following entities:

(a) Any organization authorized to occupy premises owned by or under the control of the City of Los Angeles.

(b) Any organization providing or requiring Information Technology System services if the General Manager of the Department finds and determines that the requested service is to be in the interest of the City.

Sec. 22.658. Responsibility for Payment.

(a) The cost of providing Information Technology System services as authorized by Section 22.657 shall be paid by the entity for whom the service is provided, unless otherwise determined by resolution or order of the Council. The basis of charges for such services shall be determined by the General Manager of the Department. Said charges are due and payable within thirty (30) days after notice of the amount due given by the Department.

(b) In the event any such entity fails to make payment within sixty (60) days after notice by the Department of the amount due for any such service provided, the General Manager of the Department is authorized to order the termination of such Information Technology System services and the same shall thereupon be terminated.

Sec. 22.659. Payment to General Fund.

Money collected for the cost of providing Information Technology System services, as provided in this article, shall be paid to the General Fund, unless otherwise specified by Council.

Sec. 22.660. Cost of Service to Departments Controlling Their Own Funds.

The cost of providing Information Technology System services to departments of the City of Los Angeles having control of their own funds shall be paid by such departments. The basis of charges for services provided to such departments shall be determined by the General Manager of the Department and the moneys collected therefor shall be deposited in the General Fund, unless otherwise specified by Council.

Sec. 22.661. Reimbursement Payments to Officers or Employees by various Departments.

Reimbursement payments to officers or employees of the City for Information Technology System services in connection with City business, and paid for by said officers or employees out of their personal funds, shall be made by the department in which the officer or employee is employed, and shall not be subject to the accounting procedure of the Department herein provided.

Sec. 22.662. Information Technology Systems Trust Fund.

(a) The Information Technology Systems Trust Fund is hereby created.

(b) The entities provided for pursuant to Sec. 22.657 shall deposit as a guarantee to the City of Los Angeles for the payment of the cost of providing Information Technology System services to them as authorized by said section, funds in an amount to be determined by the Department. The deposit shall be not less than twice the estimated monthly cost of the services to be provided to the entity making such deposit. Such deposit shall be made within ten (10) days after notice has been given by the Department of the required amount thereof. Those funds deposited as a guarantee shall be paid to the Department for deposit in the Information Technology Systems Trust Fund.

(c) Where Information Technology System services have been terminated for any reason and a deposit to guarantee payment for such services has been made, any amounts due, owing and unpaid to the City shall be deducted from the amount on deposit, and any balance thereof remaining after such deduction shall be refunded to the entity making the deposit.

Sec. 22.663. Reimbursement of City.

Any person or agency utilizing City Information Technology System services for personal or private use shall reimburse the City for such services in the manner and at the rates prescribed by the General Manager of the Department.

Sec. 22.664. General Manager of the Department to Establish Rules.

The General Manager of the Department is authorized to adopt suitable rules and regulations to carry out the power and authority conferred by this Article. In addition, the General Manager may, by such rules and regulations, determine that Information Technology System services should, in whole or in part, be provided by the office or department requiring the same when such is determined to be in the interest of economy or efficiency.
