§ 3-3.401. Established.¶
There is hereby established a special fund to be known as the "Drainage Fund."

§ 3-3.402. Deposits.¶
All funds received pursuant to the provisions of Section 8-1.04 of Chapter 1 of Title 8 of this Code and Section 9-1.1106(h) of Article 7 of Chapter 4 of Title 9 of this Code, as well as any additional sums authorized by the Council, shall be deposited in the Drainage Fund.

§ 3-3.403. Expenditures.¶
Moneys in the Drainage Fund shall be expended solely for the construction, or reimbursement for construction, of local drainage facilities within the Town, or to reimburse the Town for the cost of engineering and administrative services related to the Master Plan for Storm Water Drainage and the design and construction of the facilities. Facilities shall be constructed only in accordance with a priority list for channel improvements, which list shall be prepared by the City Engineer and approved by the Council. Such priority list shall be reviewed and revised annually, if appropriate, or as directed by the Council. Funds in the Drainage Fund shall not be restricted for use in a specific watershed from which they were collected, since the entire Town constitutes a single planned local drainage area. The Council hereby finds and determines that all lands within the Town have common drainage problems and that the correction of any problem is a benefit to the entire community.
