17.64.010 - Who may appeal—Filing—Fee.

The subdivider or any interested person affected by a decision of the commission may appeal to the council. Such appeals shall be filed, heard and decided within the time specified in section 66452.5 of the Government Code. The appeal shall be accompanied by a filing fee in the amount determined by resolution of the city council.

17.64.020 - Hearing—Scheduling—Notice.

At its next regular meeting after receipt of the appeal by the city clerk, the council shall set the matter for hearing. The council shall give notice of hearing of the appeal as provided by Section 17.16.180.

17.64.030 - Hearing—Conduct—Decision of council.

A hearing shall be held within 30 days after the date of the filing of the appeal. The council may deny or sustain the appeal, and sustain, reject or modify the decision of the commission, in whole or in part, or it may return the matter to the commission for further consideration and report to the council. The council may hear the testimony of any interested person and may consider any relevant evidence whether or not the same was considered by the commission. The city clerk shall forward to the appellant and the commission a written report of the decision of the council on the appeal.
