Chapter 9.64 — R4 SUBURBAN MULTIFAMILY RESIDENTIAL DISTRICT

§ 9.64.010. Purpose of district.

The R4 district is established to provide for the development and maintenance of high-density multifamily residential neighborhoods with a moderate amount of open spaces. Only those uses that are complementary to and compatible with such a residential neighborhood are permitted. (Ord. 176 § 1, 2007; Ord. 297 § 5, 2017)

§ 9.64.020. Principal uses permitted.

The following principal uses are permitted:

  • A. Multifamily dwellings with four or fewer dwelling units;

  • B. Single-family dwellings;

  • C. Parks, playgrounds, and athletic fields (noncommercial);

  • D. Residential care facilities, in accordance with Chapter 5.44 (Residential Care Facilities);

  • E. Small and large family day care homes;

  • F. Limited home rentals.

§ 9.64.030. Principal uses permitted subject to a site development permit.

The following principal uses are permitted subject to the approval of a site development permit under Section 9.184.010 :

  • A. Multifamily dwellings with five or more dwelling units (except condominium, stock cooperative, and community apartment projects) as permitted by Section 9.146.070 ;

  • B. Fire and police stations;

  • C. Public libraries and museums;

  • D. Public or private utility buildings and structures.

§ 9.64.040. Principal uses permitted subject to a use permit.

The following principal uses are permitted subject to the approval of a use permit by the Planning Commission under Section 9.184.010 :

  • A. Wireless communication facilities under Chapter 9.162 of this Code;

  • B. Churches, temples, and other places of worship;

  • C. Educational institutions;

  • D. Mobilehome developments under Section 9.176.010 ;

  • E. Residential condominium, stock cooperative, and community apartment projects under Section 9.146.070 ;

  • F. Residential planned (unit) developments under the site development standards of Chapter 9.124 ;

  • G. Any other use that the Planning Commission finds is consistent with the purpose and intent of this district.

§ 9.64.050. Temporary uses permitted.

Temporary uses are permitted in accordance with Section 9.144.070 . (Ord. 176 § 1, 2007; Ord. 297 § 5, 2017)

§ 9.64.060. Accessory uses and structures permitted.

The following accessory uses and structures are permitted when associated with and subordinate to a permitted principal use on the same legal parcel of land:

  • A. Uses per Section 9.144.080 ;

  • B. Signs, as permitted by Chapter 9.164 ;

  • C. Noncommercial keeping of pets and animals in accordance with Section 9.146.030 ;

  • D. Home occupations under Section 9.146.060 ;

  • E. Leasing offices;

  • F. Accessory uses and structures that the Director of Community Development finds are consistent with the purpose and intent of this district.

§ 9.64.070. Prohibited uses.

Notwithstanding Sections 9.64.020 through 9.64.060 , the following uses are specifically prohibited:

  • A. Keeping pets or animals for any commercial purpose;

  • B. The storage of vehicles, equipment, or products related to a commercial activity not permitted in this district;

  • C. Transitory lodgings;

  • D. Uses not expressly permitted by this chapter.

§ 9.64.080. Site development standards.

  • A. Building Site Area. Seven thousand two hundred square feet minimum except per Section 9.144.020 .

  • B. Building Height. Thirty-five feet maximum except per Section 9.144.020 .

  • C. Area per Unit. Three thousand square feet minimum net land area per dwelling unit except per Section 9.144.020 .

  • D. Distance Between Principal Structures. Fifteen feet minimum.

  • E. Building Setbacks. Per Sections 9.144.030 , 9.144.040 , and 9.144.080 .

  • F. Off-Street Parking. Per Section 9.168.010 .

  • G. Lights. All lights shall be designed and located so that direct light rays shall be confined to the premises.

  • H. Landscaping. For multifamily projects of five or more units and common areas of planned developments. Per Section 9.144.060 .

§ 9.64.090. Ancillary uses permitted.

The following ancillary uses are permitted subject to special provisions as noted:

  • A. Power supply facility in accordance with Chapter 9.166 of this Code. (Ord. 176 § 1, 2007)
