Chapter 9.151 — HOUSING ELEMENT SITES INVENTORY REGULATIONS

§ 9.151.010. Purpose.

  • A. Purpose. The purpose of this chapter is to codify in the City's Municipal Code the statutory requirements found in California Government Code Section 65583.2 that apply to rezone sites identified in Table B of the City of Lake Forest's Housing Element Sites Inventory. The Housing Element Site Inventory includes a list of potential sites to accommodate a portion of the City's unmet Regional Housing Needs Allocation, or RHNA.

  • B. Applicability. This chapter applies to residential development on a rezone site.

  • C. Relationship to Other Regulations. Residential development on a rezone site must also comply with applicable Zoning Code requirements, including, but not limited to, applicable development standards and objective design standards. Where there is a conflict between the requirements in the Zoning Code and this chapter, the provisions of this chapter apply.

§ 9.151.020. Housing element sites inventory regulations.

  • A. Residential development on a rezone site shall comply with the following regulations:

    1. The site shall permit at least 16 units;

    2. The minimum residential density is 20 dwelling units per net acre;

    3. Residential uses must occupy at least 50% of the total gross floor area of a mixed-use development;

    4. Owner-occupied and rental multifamily residential uses are permitted by right and do not require a discretionary review or approval for residential developments in which 20% or more of the units are affordable to low or very-low income households (income and affordability levels set forth in Sections 50079.5 , 50093 , and 50105 of the Health and Safety Code shall apply); and

  1. An applicant for a project under this section may apply for a density bonus in accordance with Government Code Section 65915 and Zoning Code Chapter 9.152 .
