Sec. 2-1. - Board of Supervisors.

1.2 Board Meetings.

(a) The Board of Supervisors shall meet on the first four (4) Tuesdays of each month, commencing at 9:00 a.m.

(b) Any regular meeting of the Board of Supervisors that falls upon a holiday is cancelled.

(c) Said meeting shall be held in the Board of Supervisor's Chambers, Courthouse, at Lakeport, California.

(d) The Board of Supervisors may adjourn any regular, adjourned regular, special or adjourned special meeting to a time and place specified in the order of adjournment. If all members are absent from any regular or adjourned regular meeting, the Clerk of the Board may declare the meeting adjourned to a stated time and place in the manner provided by State law (Section 54955 of the Government Code).

(e) Special meetings of the Board of Supervisors may be called in the manner provided by State law (Section 54956 of the Government Code); however, no business except those items listed as business to be transacted on the special meeting notice shall be considered.

(f) A quorum shall consist of three (3) members of the Board. If a quorum is not present, then the Board shall adjourn to the next regular meeting or to an earlier date.

(g) A majority of the members of the Board of Supervisors shall constitute a quorum for the transaction of business. No act of the Board shall be valid or binding unless a majority of all members concur therein.

(h) Board meetings shall be open to both the public and the news media. The only exception shall be a closed session at which members of the public and the news media shall be excluded. All closed sessions shall discuss only those items allowed in Section 54950 et seq. of the Government Code (Ralph M. Brown Act).

(i) All procedural questions not specifically addressed by this Article shall be decided according to generally accepted parliamentary procedure.

1.3 Election, Powers and Duties of Chairman.

(a) The presiding officer at all meetings of the Board of Supervisors shall be the Chairman of the Board who shall be chosen as follows:

(1) The Chairman shall be elected during the first regular January meeting and shall serve a one year term, taking office upon election. A Supervisor will not be elected as Chairman unless he has served as a Supervisor for one (1) year.

(2) The Chairman shall be elected in open session by a majority voice vote of the Board.

(3) No Supervisor may serve as Chairman for more than two (2) consecutive terms.

(b) The Chairman shall have the following duties and responsibilities: To open all meetings by calling the members to order; to adjourn all meetings; to announce the business before the Board in the order in which it is to be acted upon; to recognize any individual who wishes to speak; to state the question; to put the question; to announce the results of the vote. In addition, the Chairman shall preserve order and decorum; he may speak on all questions of order in preference to any other member; and shall decide all questions of order subject to appeal by the Board.

(c) The Vice-Chairman of the Board of Supervisors shall be chosen as follows:

(1) The Vice-Chairman shall be elected during the first regular January meeting and shall serve a one-year term, taking office upon election.

(2) The Vice-Chairman shall be elected in open session by a majority voice vote of the Board.

(d) The Vice-Chairman shall serve in the absence of the Chairman or when the Chairman is unable to act, with all the duties and powers of the Chairman.

1.4 Agenda.

(a) The agenda of the Board of Supervisors shall consist of a consent agenda and a regular agenda. The Consent agenda may include all matters originating from, or requested by, county departments, agencies, committees and commissions except those matters requiring public hearing. The regular agenda shall include those items requiring public hearings and may include those matters which otherwise cannot reasonably be considered for the consent agenda.

(b) Matters originating from, or requested by, county departments, agencies, committees or commissions to be considered by the Board shall be approved for placement on the agenda by the Chairman of the Board of Supervisors or the Clerk of the Board. They shall be submitted by the deadline dates established pursuant to this article.

(c) Agenda deadline dates shall be established by the Clerk of the Board; provided, however, that the deadline for consideration for the consent agenda shall be no less than seven (7) calendar days prior to the intended Board meeting date.

(d) All matters originating from, or requested by, county departments, agencies, committees or commissions shall be submitted by the deadline date to the Clerk of the Board in the manner prescribed by the Board of Supervisor's Policy. It shall be the responsibility of the requesting department, agency, committee or commission to supply all necessary materials including ordinances, resolutions, contracts, correspondence and supporting documentation where appropriate.

(e) Items shall be placed on the agenda whenever so requested by any Supervisor. Such request shall be made to the Chairman of the Board or the Clerk of the Board.

(f) Correspondence from individuals or organizations outside county departments may be screened by the Chairman for placement on the agenda or referral for appropriate action or response.

(g) In addition to those items on the written agenda, other matters may, with the concurrence of the Chairman, be brought before the Board. It is the policy of the Board, however, that all matters should, wherever feasible, be submitted for inclusion on the written agenda.

1.5 Procedure for Acting on Business.

(a) Consent Agenda.

(1) All matters on the consent agenda shall be approved by one motion unless any board member requests separate action on a specific item, in which case that item shall be transferred to the regular agenda for action.

(b) Regular Agenda.

(1) The Chairman shall announce each item of business before the Board. In all matters considered before the Board, the proponents of each matter shall first be given the opportunity to speak.

(2) Each motion made by any member of the Board shall require a second. Motions and seconds may be made by any member except the Chairman, or the Vice-Chairman when acting as Chairman.

(3) After a motion has been made and seconded and after debate and discussion appear to be closed, the Chairman shall ask, "Are you ready for the question?" If no member objects then the Chairman shall proceed to "put the question." If, however, there is an objection, then the debate or discussion shall continue until concluded. Discussion may be concluded by the passage of a motion to "Close the debate." The Chairman shall put the question by first calling for the affirmative vote and then the negative vote. Immediately following the vote, the Chairman shall announce the results of the vote.

(4) A roll call vote shall be taken by the Clerk on all ordinances. Each roll call of the Board shall be by supervisorial districts in numerical order except the Chairman shall be called last.

1.6 Ordinances and Resolutions.

(a) Ordinances and resolutions may be introduced by any member of the Board of Supervisors.

(b) A resolution may be adopted at any time subsequent to its introduction without reading. The resolution shall be read before adoption if requested by a member of the Board.

(c) Every emergency ordinance may be adopted by four-fifths (⅘) vote of the Board upon introduction. Findings of fact shall be contained in the body of the emergency ordinance.

(d) Every ordinance which by statute can be passed only after notice and a public hearing, may be adopted upon introduction. Interim zoning ordinances may be adopted by a four-fifths (⅘) vote of the Board upon introduction.

(e) Every other ordinance shall be considered at two (2) regular or adjourned regular meetings of the Board which are at least five (5) days apart before being introduced for final passage. Every ordinance shall be read in full upon introduction, except if it is waived by unanimous consent of the Board of Supervisors, in which case only the Title must be read.

(f) Ordinances shall advance and be placed on the agenda for adoption only if they receive three (3) affirmative votes of the Board upon introduction. Any ordinance which fails to receive three (3) affirmative votes may be reintroduced at any subsequent meeting of the Board.

(g) At the next regular session following introduction, an ordinance which has advanced is then ready to be offered for final passage.

(h) Ordinances which are defeated when offered for final passage, or after having been first introduced twice, may not be reintroduced for six (6) months without majority concurrence.

(i) Ordinances and resolutions may be amended at any time before final passage; however, amended ordinances may not be passed until the next regular session which is at least five (5) days after the date of amendment.

(j) After final passage, an ordinance or resolution may be reconsidered at the same meeting of the Board, upon vote of a majority thereof. If a motion for reconsideration is passed, the vote on the ordinance or resolution shall be a nullity.

(k) After final passage, an ordinance may be rescinded at any time before its effective date, upon vote of a majority of the members of the Board. If a motion for recision is passed, the vote on the ordinance shall be a nullity.

(l) After reconsideration or rescission, the Board may, at that meeting or any subsequent meeting, reconsider the ordinance or resolution, make desired changes, and without further reading may adopt it, provided that if an ordinance is altered it may not be adopted until the next regular meeting of the Board which is at least five (5) days after the meeting at which the alteration was made.

1.7 Action of Board Members.

(a) Individual Board members shall not direct County offices or departments. Direction of County operation—the setting of policy—shall be by action of the Board of Supervisors, with implementation through the Department Heads and overview by the County Administrative Coordinator.

(b) Board members must be cognizant of the fact that they represent the County at all times and their conduct shall be ruled accordingly.

1.8 Special District Directors.

(a) Any action taken by the Board of Supervisors on behalf of or relating to a special district, [for] which the Board of Supervisors is by law the Board of Directors, is deemed to have been taken by the Board of Directors of said District.

(b) The Clerk of the Board of Supervisors is directed to indicate on the record that any action taken by the Board of Supervisors on behalf of or relating to a special district [for] which the Board of Supervisors is by law the Board of Directors, was taken by the Board of Directors of the appropriate special District.

Sec. 2-2. - Office Hours of County Offices.

2.2 Under extraordinary circumstances, County department heads shall be authorized to…

2.2 Under extraordinary circumstances, County department heads shall be authorized to close offices to the public between the hours of 12:00 noon and 1:00 p.m. For the purposes of this section, extraordinary circumstances may include a temporary staffing shortage due to position vacancies, employee illness, or other employee absences which result in the inability to provide continuous service to the public as described herein. Department heads shall make every reasonable effort to avoid such office closures. This paragraph pertains to unexpected or developing needs that only occasionally arise and cannot be anticipated, and is not intended to authorize regular noontime closures.

In the event of persistent extraordinary circumstances, which may include long-term staffing reductions due to any cause or a high percentage of developing staff, a department head may submit a request for temporary alternate office hours to the Board of Supervisors for consideration, in the form of a draft Resolution. Persistent, for the purposes of this section, shall mean in excess of three (3) days per month, or on an ongoing basis for any known period of one (1) or more month(s).

Final approval of temporary alternate office hours shall be by Resolution of the Board, documenting the interval at which the change shall be reviewed.

If a permanent change in office hours is needed to facilitate best possible customer service, the department head shall prepare an ordinance, documenting their proposed office hours for consideration.

Department heads shall take all reasonable steps to notify the public of any departures from customary office hours.

The Board and the County Administrative Officer, as consistent with their customary duties, shall likewise retain the right to review permanent changes of office hours, as needed.

Sec. 2-3A. - Compensation of the Board of Supervisors.

3A.1 Salary.

(a) Each member of the Board of Supervisors of the County of Lake shall receive as an annual salary for services rendered by law and by virtue of each of their offices, a sum equal to thirty-eight point six one eight percent (38.618%) of the annual salary of Lake County Superior Court judge (Class Code L9999).

(b) In addition to the foregoing annual salary, the Chair of the Board shall receive additional annual compensation of five percent (5%) of the above-described annual salary.

3A.2 Supervisors shall, in addition, be entitled to mileage and travel expenses incurred in the conduct of official business in accordance with the County of Lake Travel and Reimbursement Policy."

3A.3 Supervisors shall, in addition, be entitled to the same group insurance, retiree group insurance, Public Employees Retirement System, Federal Insurance Contributions Act retirement and cellular phone stipend benefits which are received by management employees of the County of Lake.

3A.4 The Vice-Chairman of the Board, in addition to the foregoing, shall receive the additional compensation set forth above for the Chairman when required to serve as "acting" Chairman during an extended absence of the Chairman. This additional compensation shall commence on the sixteenth (16th) consecutive workday of such service, or the sixteenth (16th) day accumulated in any sixty (60) calendar period.

Sec. 2-3B. - Trial and Grand Jurors.

3B.1 Mileage. Grand Jurors shall receive mileage reimbursement in accordance with the County of Lake Travel and Reimbursement Policy."

3B.2 Supervisors shall, in addition, be entitled to mileage and travel expenses incurred in the conduct of official business in accordance with the County mileage and expense policies. Supervisors shall also be entitled to mileage for each mile necessarily traveled going to and from their residence to the Courthouse in Lakeport, California; such mileage shall be deemed to be in the conduct of official business for purposes of this section. The mileage reimbursement rate shall be computed at the rate of thirty-nine cents ($0.39) per mile.

Sec. 2-3C. - Training and Orientation of Newly Elected Supervisors.

3C.1 Upon request of a supervisor-elect, county general fund monies may be used prior to the assumption of office by that supervisor-elect, for the training and orientation of that supervisor-elect including the payment of course fees, travel and per diem expenses, course materials, and consultant fees.

3C.2 Such training and orientation programs, and expenses therefor, shall be those the Board deems proper and beneficial to the exercise of supervisorial duties by newly elected supervisors.

3C.3 In order to receive training and orientation funds, the supervisor-elect shall make a formal request of the Board of Supervisors.
