Chapter 31 — EDIBLE FOOD RECOVERY ORDINANCE
Article VII — PERMITS AND FEES

Sec. 701. - Application for Permit and Payment of Charges.
Any person legally entitled to apply for and receive a permit shall make such application on forms provided by the District for that purpose. He shall give a description of the character of the work proposed to be done and the location, ownership, occupancy and use of the premises in connection therewith. The Administrator may require plans, specifications or drawings and such other information as he may deem necessary.
In the event the applicant for a permit is required to provide plans, specifications or drawings and information as a condition to the issuance of the permit, the applicant shall pay all engineering, legal, administrative and other expenses and charges prior to the issuance of the permit.
If the Administrator determines, with the advice and consent of the Engineer, that the plans, specifications, drawings and other information furnished by the applicant are satisfactory and are in compliance with the ordinances, rules and regulations of the District, he shall issue the permit applied for upon payment of the charges herein referred to and of the fees as hereinafter fixed.

Sec. 702. - Compliance with Permit.
After approval of the application, evidenced by the issuance of a permit, no change shall be made in the location of the sewer, the grade, materials, or other details from those described in the permit or as shown on the plans and specifications for which the permit was issued except with written permission from the District, the Administrator or other authorized representatives.

Sec. 703. - Fees and Charges—Permit, Inspection and Construction. (A) Permit issuance and inspection fee for new construction and for existing facilities including abandonment of septic tank. $50.00
(B)
Public sewer connections:
(1)
All work shall be performed by a licensed contractor hired by the applicant. In cases where the applicant is unable to retain the services of a licensed contractor, District may, in its sole discretion, agree to perform
the work according to the fees and charges herein.
(2)
When applicant has retained the services of a licensed contractor to perform construction, applicant shall be solely responsible for any and all costs associated with that construction. In addition, applicant shall be required to pay a fee to District for any inspection of sewer lateral construction as follows:
a.
Fifty dollars ($50.00) per inspection.
In cases where the applicant is unable to retain the services of a licensed contractor, and the District agrees to perform said construction, applicant shall make application with District for construction of Sewer Service Line (Lateral) from Mainline to Property Line, including Cleanout. The following charges shall be paid by applicant:
a.
Four inches (4″) Diameter Service Line: $1,186.00 + $24.00 per Lineal Foot
b.
Six inches (6″) Diameter Service Line: $1,186.00 + $35.00 per Lineal Foot
c.
The charges above shall be adjusted January 1 of each year. The inflationary adjustment shall be determined by multiplying the current rate by the percentage of increase of the prior year's average annual U.S. City Average Consumer Price Index as published by the U.S. Department of Labor, Bureau of Labor Statistics. In the event of a negative index, no change in the above charges shall be made.

(D)
Encroachment permit:
(1)
District shall obtain the Encroachment Permit from the Department of Public Works. The amount charged for said permit will include the inspector's mileage and inspection services.
(2)
Upon completion of work, District shall bill applicant in the amount charged by the Department of Public Works for the Encroachment Permit.
(3)
Applicant shall reimburse District the amount charged and shall make payment in full to District within thirty (30) days of billing date.

Sec. 704. - Fees—Annexation Charges.
The owner or owners of lands within areas proposed to be annexed to the District shall deposit with the District a sum to be fixed by the District prior to the commencement of proceedings by the Board on the proposed annexation. The amount to be fixed by the District shall be in a sum estimated to equal the engineering, legal and publication costs and all other charges which may be incurred by the District in preparing and examining maps, legal descriptions, and other documents in relation thereto, and other expenses regularly incurred in connection therewith.

Sec. 705. - Fee—Connection Charges.
In addition to any other charges established by the ordinances, rules and regulations of the District, there shall be collected, prior to connection to the sanitary sewerage system of the District, special connection charges, as follows:
(A)
Assessment Connection Charge: For any parcel, unit or lot, or part of said property, lying within the present boundaries of said District or hereafter annexed to said District, which abuts on or can be served by any existing sewer main or other sanitary sewerage facilities of said District constructed pursuant to special assessment proceedings, additional connection charges to be paid prior to the issuance of a permit for sewer connection in any such areas; are hereby established as follows:
(1)
An additional connection charge shall be collected, in a sum to be computed by the Administrator, as said property's share of the cost of the existing sewerage facilities of the District to be used by said property. Said sum shall be the equivalent of the cost to similar properties within the District which were fully assessed for said facilities so to be used. Said sum shall include all costs incident to the installation of such facilities, together with interest charges thereon.
Property subject to such additional connection charge include, but are not limited to:
(a)
Properties outside of the boundaries of assessment districts established pursuant to special assessment proceedings;
(b)
Properties within the boundaries of an assessment district but against which no assessment was levied; and
(c)
Properties within the boundaries of an assessment district but against which a partial assessment only was levied on the theory of partial benefit, as for example, in the case of adjoining 25-foot frontage lots in common ownership.
(B)
Special Agreement Connection Charge: For any parcel, unit or lot, or part of said property which abuts on or can be served by any existing sewer main or other sanitary sewerage facilities of said District constructed pursuant to special agreement, wherein the District has agreed to reimburse to the party making the original installation a share of the cost of original construction attributable to parcels of property later connecting to said main or facilities, special connection charges in addition to any other charges established by the District, which must be paid prior to the issuance of a permit for sewer connection, are hereby established, as follows:
(1)
An additional special connection charge shall be collected in a sum to be computed by the Administrator as said property's share of the cost of the sewer mains and other sanitary sewerage facilities of the District, constructed pursuant to special agreement, to be used by said property. Said sum shall be equivalent to the pro rata share of the cost of the installation made pursuant to the special agreement which would have been paid by said property for the facilities so to be used if said property had contributed its equitable share to the original cost of construction. Said sum shall include all costs incident to the installation of such mains and facilities.
(C)
Improvement District Connection Charge: For any parcel, unit or lot, or part of said property which abuts on or can be served by any existing sewer main or other sanitary sewerage facilities of said District constructed pursuant to proceedings for the formation of an improvement district and financed, all or in part, through the issuance and sale of general obligation bonds of the District for said improvement district, and which parcel, unit or lot, or part of said property is hereafter annexed to said improvement district, additional connection charges to be paid prior to the issuance of a permit for sewer connection are hereby established as follows:
(1)
An additional connection charge shall be collected, in a sum to be computed by the Administrator, as said property's share of the cost of the existing sanitary sewerage facilities of the District so constructed and financed. Said sum shall be equivalent to the total amount that said property would have paid in annual taxes for the payment of said general obligation bonds had said property been included with said improvement district from the time such annual tax was first levied. For the purpose of computing said sum, the actual bond tax rate levied in said improvement district in each applicable year, and the assessed value of said property in each year, as shown in the records of the County Assessor, shall be applied.

Assessment District No. 2-2, Middletown, Special Connection Charge. A Special Connection Charge for each single-family equivalent unit shall be collected by the District in the amount of one thousand, four hundred sixty-seven dollars and thirty-four cents ($1,467.34) for all new construction not assessed under Assessment District No. 2-2, plus the percentage increase in the Engineering News Record Construction Index from January 1, 1991 (4777) to the time of permit application.
A reduction factor of 0.7 will be calculated for Mobilehome Park Spaces for each space after the first unit.
A reduction factor of 0.5 will be calculated for Motels after the first unit or Manager's complex.

Editor's note— Ord. No. 2953, § 2, adopted July 12, 2011, provides that the Special Districts Administrator shall annually increase all fees adopted pursuant to this Ordinance, by the Engineering New Record- Construction Cost Index, (ENR) and shall use the percent change of that index from January to December of each year. The Special Districts Administrator shall prepare by March 10 of each year the proposed schedule of fees for Special Districts Administration that includes the appropriate ENR increase and will ensure these accurately reflect the appropriate ENR adjustment and, if satisfied with the accuracy of the fee adjustment, shall increase fees and provide appropriate notice to the public of the increase on or before May 1st of each year. Adjustments to the fees shall be effective on July 1st of each year, beginning in 2012. The department will review annually revenues and expenditures to ensure that the fees are charged fairly and reflect the cost of the services provided. Sec. 707. - Construction Finance Fee—Lake County Sanitation District.
A construction finance fee shall be collected for any new construction, dwellings, or granny units, which are located on a parcel within the service area of the Lake County Sanitation District which the present or any past owner has not paid the full amount of funds that were necessary to finance the collector system serving said parcel. The amount of the fee shall be a sum equivalent to the total cost that has been incurred by the District to finance the collector system for the subject parcel, minus any payments that have been made by the present or any past owners toward the construction finance cost of the collector system serving the subject parcel.

Sec. 708. - Public Sewers on County Maintained Roads.
(A)
Permits and Inspection Fees. Permits shall be obtained from the Department of Public Works, County of Lake in the form of an Encroachment Permit. Fees for such inspections shall be as adopted by the County of Lake.

(B)
Saddles and Tees. The District will assist Public Works in the inspection of all saddles and tees which are connections to main trunk, interceptor and lateral sewer lines.
(C)
Renewal or Extension of Encroachment Permits. Whenever a permit for public sewer expires, as provided in Section 720 of this Ordinance, an additional fee may be charged as determined by the Public Works for such renewal or extension.

Sec. 709. - Trunk Sewer Charge.
(A)
Collector Sewer Charge. In addition to any other fees and charges established by the ordinances, rules and regulations of the District, there shall be collected, prior to connection to the sanitary sewerage system of the District, a Trunk Sewer Charge to be paid by persons desiring to connect a side sewer directly to an existing trunk sewer main of the District which was installed without direct cost to the connecting property with respect to its use as a collector sewer, which charge shall be established by separate ordinance of the Board.

Sec. 710. - Disposition of Fees.
All fees collected on behalf of the District shall be deposited with the proper authority provided by the District to receive such funds.

Sec. 711. - All Work to be Inspected.
All sewer construction work, building sewers, plumbing and drainage systems shall be inspected by an inspector acting for the District to insure compliance with all requirements of the District. No sewer shall be covered at any point until it has been inspected and passed for acceptance. No sewer shall be connected to the District's public sewer until the work covered by the permit has been completed, inspected and approved by the District Inspector. All sewers shall be tested for leakage in the presence of the District Inspector and shall be cleaned of all debris accumulated from construction operations. If the test proves satisfactory, the Inspector shall issue a certificate of satisfactory completion.

Sec. 712. - Notification.
It shall be the duty of the person doing the work authorized by permit to make notification as required on the Encroachment Permit issued for the work involved. It shall be the duty of the person doing the work to make sure that the work will conform to permit requirements by the District before giving the above notification.

Sec. 713. - Non-Conforming Work.
When any work has been inspected and the work is not approved, notice to that effect shall be given instructing the Owner of the premises, or the agent of such Owner, to repair the sewer or other work authorized by the permit in accordance with the ordinances, rules and regulations of the District.

Sec. 714. - All Costs Paid by Owner.
All cost and expenses incident to the installation and connection of any sewer or other work for which a permit has been issued shall be borne by the Owner. The Owner shall indemnify the District from any loss
or damage that may directly or indirectly be occasioned by the work.

Sec. 715. - Outside Sewers.
Permission shall not be granted to connect any lot or parcel of land outside the District to any public sewer in or under the jurisdiction of the District unless a permit therefor is obtained. The applicant shall first enter into a contract in writing whereby he shall bind himself, his heirs, successors and assigns to abide by all ordinances, rules and regulations in regard to the manner in which such sewer shall be used, the manner of connecting therewith, and the plumbing and drainage in connection therewith and also shall agree to pay all fees required for securing the permit and a monthly fee in the amount set by the District for the privilege of using such sewer,

Sec. 716. - Permit Optional.
The granting of such permission from an outside sewer in any event shall be optional with the Board.

Sec. 717. - Special Outside Agreements.
Where special conditions exist relating to an outside sewer, they shall be the subject of a special contract between the applicant and the District.

Sec. 718. - Street Excavation Permit.
An Encroachment Permit must be secured from the County or any other person having jurisdiction thereover by Owners or Contractors intending to excavate in a public street for the purpose of installing sewers or making sewer connections.

Sec. 719. - Liability.
The District and its officers, agents and employees shall not be answerable for any liability or injury or death to any person or damage to any property arising during or growing out of the performance of any work by such applicant. The applicant shall be answerable for, and shall save the District and its officers, agents and employees harmless from any liability imposed by law upon the District or its officers, agents, or employees including all costs, expenses, fees and interest incurred in defending same or in seeking to enforce this provision. Applicant shall be solely liable for any defects in the performance of this work or any failure which may develop therein.

Sec. 720. - Time Limit on Permits.
If the work authorized by a permit is not completed within one hundred twenty (120) days from issuance, the permit shall become void and no further work shall be done until a new permit shall have been secured.

Sec. 721D. - Late Fees.
A late fee of five dollars ($5.00) shall be added to each unpaid bi-monthly sewer billing after sixty (60) days from the billing date. Said late fee shall be added to each sewer account for those properties served by the Lake County Sanitation District.

Sec. 722. - Collection of Delinquent Fees.
Delinquent charges shall be collected at the same time and in the same manner and by the same persons as general County taxes (pursuant to Health and Safety Code Section 5473.7).

Sec. 723. - Disconnection of Long Term Delinquent Sewer Accounts.
Notwithstanding Section 722, any sewer service account which has been delinquent for eighteen (18) months or longer shall be subject to disconnection pursuant to this section. When the Administrator determines that a sewer service account has been delinquent for eighteen (18) months or longer, he shall notify the owner and occupier of the delinquent property by certified return receipt requested that if the sewer service account for the subject property is not paid in full within thirty (30) days of the mailing of said notice, the Administrator shall disconnect the sewer service from the sewer mains of the District and that upon disconnection from the sewer mains, that sewer service shall not be restored until the sewer service account has been paid in full together with payment for the costs of disconnection which is hereby determined and established to be five hundred dollars ($500). Said notice shall also advice the owner/occupant of date, time and place of the hearing before the Board of Directors, to show cause, if any reason exists, why the sewer disconnection should not be carried out.
At least seven (7) calendar days prior to disconnection, the Administrator shall, prominently and conspicuously, affix to the premises affected by the sewer disconnection, a written notification of the Administrator's intention to disconnect sewer service for delinquent payment. Said notice shall state the
intended date of disconnection as well as the action that must be taken by the property owner/occupant to terminate the disconnection process.
