Sec. 2.1. - Rate Schedule.

Sewer service charges are hereby prescribed in accordance with the schedule of charges set forth in Exhibit "A" hereto attached and by reference made a part hereof.

Sec. 2.2. - Use of Revenues.

Revenues derived under this ordinance shall be used only for the acquisition, construction and reconstruction, maintenance and operation of sanitation or sewerage facilities of the District and to repay principal and interest on bonds issued for the construction of such sanitary or sewerage facilities and to repay federal or state loans or advances made to the District for the construction or reconstruction of sanitary or sewerage facilities; provided, however, that such revenue shall not be used for the acquisition or construction of new local street sewers or laterals, as distinguished from main trunk, interceptor and outfall sewers.

Sec. 2.3. - Connection Fee—One Time Charge.

A special connection charge as provided for in Section 706, Article VII, Appendix A of Ordinance No. 871 is hereby established as the Sewer Capacity Expansion Connection Fee, and shall apply to new units constructed on otherwise unimproved property or additions to improved property within the District or any area that receives sewer service from the Kelseyville County Waterworks system, as follows:

[DIVISION 2.] - [ANDERSON SPRINGS] [Sec.] 1.1 - Short Title.

This ordinance may be cited as "Anderson Springs Sewer Service Charge Ordinance."

[Sec.] 1.2 - Definitions.

Unless the context otherwise indicates, terms used herein have the following meanings:

(a)

"District" means Anderson Springs Sewer System

(b)

"Sewer service charges" means fees, tolls, rates, rentals or other charges for services and facilities furnished by District in connection with its sanitary sewerage system.

[Sec.] 1.3 - Separability.

This Board hereby declares that it would have passed this ordinance and each section, sub-section, sentence, clause or phrase thereof, irrespective of the fact that any one or more of the sections, sub- sections, sentences, clauses or phrases be declared unconstitutional.

[Sec.] 1.4 - Inconsistent Ordinance and Regulations.

All ordinances and regulations or parts of ordinances and regulations inconsistent herewith are hereby repealed.

[Sec.] 2.1 - Rate Schedule.

Sewer service charges are hereby prescribed in accordance with the schedule of charges set forth as follows:

The above sewer charges, items 1 through 3, including monthly charges, shall be adjusted February 15 of each year based on inflation. The inflationary adjustment shall be determined by multiplying the current rate by the ratio of the prior year's average annual U.S. City Average Consumer Price Index as published by the U.S. Department of Labor, Bureau of Labor Statistics. In the event of a negative index, no change in the sewer charges shall be made. The Consumer Price Index inflationary adjustment is publicized annually by February 1 st on Special Districts website.

[Sec.] 2.2 - Use of Revenues.

Revenues derived under this ordinance shall be used only for the acquisition, construction and reconstruction, maintenance and operation and or replacement of sanitation or sewerage facilities of the

District.

ORDINANCE NO. 1465

An Ordinance Establishing a Cross-Connection Control Program to Protect the Public Water Systems

The Board of Directors of the Kelseyville County Waterworks District No. 3, Lake County, California, Does Ordain as Follows:

Section 1. - Protection of Public Water Systems.

1.1 Purpose and Intent.

Pursuant to Section 450 of the California Health and Safety Code and Title 17,

Section 1174 et seq. of the California Administrative Code, a Cross-connection Control Program is established in the Kelseyville County Waterworks District No. 3 for the following purposes:

(a)

To protect the public water supply against actual or potential cross-connections by isolating within the premises contamination or pollution that may occur because of some undiscovered or unauthorized cross- connection on the premises;

(b)

To eliminate existing connections between drinking water systems and other sources of water that are not approved as safe and potable for human consumption;

(c)

To eliminate cross-connections between drinking water systems and other sources of water or process water used for any purpose whatsoever which jeopardize the safety or the drinking water supply; and

(d)

To prevent the making of cross-connections in the future.

1.2 Definitions.

For the purposes of this Ordinance, the following terms shall have the following meanings:

(a)

Cross-connection means any unprotected connection between any part of a water system used or intended to supply water for drinking purposes and any source or system containing water or substance that is not or cannot be approved as safe, wholesome, and potable for human consumption.

(b)

Approved water supply means any water supply approved by or under the public health supervision of a public health agency of the State of California, or its political subdivisions. In determining what constitutes an approved water supply, the State Department of Public Health reserves final judgment as to its safety and potability.

(c)

Auxiliary supply means any water supply on or available to the premises other than a public water supply.

(d)

Approved check valve means a check valve that seats readily and completely and has been approved for use in the Kelseyville County Waterworks District No. 3.

(e)

Approved double check valve assembly means an assembly of at least two independently acting approved check valves including tightly closing shut-off valves on each side of the check valve assembly and suitable leak-detector drains plus connections available for testing the water tightness of each check valve.

(f)

Air-gap separation means a physical break between a supply pipe and a receiving vessel. The air-gap shall be at least double the diameter of the supply pipe measured vertically above the top rim of the vessel, in no case less than one inch.

(g)

Approved reduced pressure principle backflow prevention device means a device incorporating two or more check valves and an automatically operating differential relief valve located between the two checks, two shut-off valves, and equipped with necessary appurtenances for testing. The device shall operate to maintain the pressure in the zone between the two check valves less than the pressure on the public water supply side of the device.

(h)

Approved backflow device means:

(1)

An approved double check valve assembly; or

(2)

An approved air-gap separation; or

(3)

An approved reduced pressure principle backflow prevention device.

(i)

District water system means a system of water delivery operated and maintained by the Kelseyville County Waterworks District No. 3 formed pursuant to Section 55000 et seq. of the Water Code of the State of California.

(j)

Premise or premises means land and everything appurtenant thereto, including but not limited to, buildings, structures, and mobilehomes.

(k)

County Utilities Manager means the County Utilities Manager for the County of Lake, State of California.

1.3 Cross-connection and Protection Requirements.

3.1

Except as otherwise provided by this Ordinance, no person or entity shall cause a connection to be made between plumbing pipes, plumbing fixtures or appurtenances thereof served with water supplied by a district water system and plumbing pipes, plumbing fixtures or appurtenances thereof served by any other source of water.

3.2

Except as otherwise provided by this Ordinance, no person or entity shall install or use any plumbing pipes, plumbing fixtures or appurtenances thereof which by their construction or means of hook-up, may permit a backflow of water or any other liquid or substance into a district water system or into the service system of a consumer of water from such system.

1.4 Permit Required for Cross-connection.

4.1

Any person or entity that installs or maintains a cross- connection on any premises shall obtain a permit for such cross-connection from the County Utilities Manager.

4.2

As a condition for the issuance of such permit, the person or entity wishing to maintain a cross-connection shall install an approved backflow prevention device.

4.3

Installation of an approved backflow prevention device shall be required under the following circumstances:

(a)

An approved backflow prevention device shall be installed at each service connection of a district water system where the premises served is also served by an auxiliary water supply not approved by the public health agency having jurisdiction.

(b)

An approved backflow prevention device shall be installed at each service connection of a district water system where the premises served has upon it any liquid or substance under pressure which may enter a district water system. Such liquid or substance includes, but is not limited to, waters originating from a district water system which have been contaminated below the health standards established for a district water system.

(c)

An approved backflow prevention device shall be installed at each service connection of a district water system where the premises served has upon it a cross-connection; provided however, no backflow prevention device is required pursuant to this subsection where such cross-connection has been modified to prevent any contamination of a district water system and such modification has been approved, in writing, by the County Utilities Manager and has been approved by the State or County Health Department.

1.5 Requirements for Installation of Back flow Prevention Device.

5.1

When a backflow prevention device is required to be installed pursuant to this Ordinance, the following shall apply:

(a)

Any person or entity that is required to install a back- flow prevention device pursuant to this Ordinance shall first obtain a permit for such installation from the County Utilities Manager.

(b)

Any backflow prevention device installed must be approved by the Foundation for Cross-connection Control and Hydraulic Research of the University of Southern California.

(c)

Any backflow prevention device shall be installed in accordance with the methods of installation prescribed in the "Manual of Cross-connection Control Procedures and Practices" prepared by the California State

Department of Health Services Sanitary Engineering Section or as prescribed and approved in writing at his discretion by the County Utilities Manager.

(d)

Any person or entity which owns any premises where a backflow prevention device has been installed shall have such device inspected annually by a Certified Inspector pursuant to the applicable Rules and Regulations of the California State Department of Public Health. A written report of the inspection shall be filed by the owner of the premises with the County Utilities Manager on the second Monday of each January of each year the device remains installed.

(e)

The Kelseyville County Waterworks District No. 3 shall not be liable for any costs for the inspection, repair, or maintenance of any backflow prevention device installed pursuant to this Ordinance. All such costs shall be borne by the owner of the premises.

1.6 Installation of Backflow Prevention Devices for Premises with Existing Cross-connections.

6.1

Upon adoption of this Ordinance, the County Utilities Manager shall conduct a survey of all premises affected by the requirements of this Ordinance to determine those premises which have an actual or potential cross-connection.

6.2

The owner of each premises as determined by the County Utilities Manager shall install or cause to be installed an approved backflow prevention device within one (1) year from the effective date of this Ordinance.

6.3

Upon the determination by the County Utilities Manager that a backflow prevention device is required upon the premises, the County Utilities Manager shall serve notice upon the owner of said premises, as determined from the last assessment roll, by depositing in the mail, postage prepaid, certified, return receipt requested, a notice that the premise has been determined to be subject to the provisions of the Ordinance and the steps the owner of the premises must take to comply with such provisions.

6.4

After receiving the notice required by subsection 6.3, above, the owner of the premises shall do one of the following:

(a)

Obtain a permit pursuant to the provisions of this Ordinance, and install the device following the procedures set forth in subsection 5.1, subdivision (c) of this Ordinance. The total cost of such installation shall be borne by the owner of the premises; or

(b)

Request the County Utilities Manager to install the device; provided however, the owner of the premises shall be liable only for those costs incurred for purchase of the materials used for such installation. Upon installation, the owner of the premises shall be responsible for all costs of inspection, repair, and maintenance of the backflow prevention device.

1.7 Discontinuance of Service.

7.1

Service of water to any premises served by a district water system may be discontinued for noncompliance with the provisions of this Ordinance. Service shall be restored only upon compliance with the provisions of this Ordinance.

1.8 Right of Entry.

8.1

The County Utilities Manager, or his designee, shall inspect premises for noncompliance with the provisions of this Ordinance. He shall carry proper credentials of his office, upon exhibition of which he shall have the right of entry, during usual business hours, to inspect all premises in the performance of his duty. This right of entry shall be a condition of water service in order to provide assurance that the continuation of service to the premises will not constitute a menace to the health, safety and welfare of the people throughout a district water system.

1.9 Certification of Tester.

9.1

Each applicant for certification as a tester of backflow prevention devices shall file an approved application with the Environmental Health Division of the County Health Department together with a fee as may be established by the Board of Directors.

9.2

Competency in all phases of backflow prevention device testing and repair must be demonstrated by means of education or experience, or both, in order to obtain certification. The following are minimum requirements:

(a)

Applicants shall have had at least two (2) years experience in plumbing or pipe fitting or equivalent qualifications;

(b)

Applicants shall hold a valid certification from the American Water Works Association, California-Nevada Section, or satisfactory completion of the course for the Training and Certification of Testers for Backflow Prevention Devices offered by the Foundation for Cross-connection Control and Hydraulic Research,

University of Southern California, or have equivalent training as determined by the County Utilities Manager and the Director of the Lake County Health Department or his authorized designee; and

(c)

Each applicant shall furnish evidence to show that he has available the necessary tools and equipment to properly test such devices. He shall be responsible for the competency and accuracy of all tests and reports prepared by him.

9.3

The certificate issued to any tester is valid for a period of one (1) year from date of issuance. The certificate may be revoked, suspended or not renewed for unsatisfactory testing, unsatisfactory repairs, or filing a report that misrepresents the condition of the device tested.

Section 2. - Scope.

This Ordinance shall apply to the Kelseyville County Waterworks District No. 3.

APPENDIX E - WATER CONSERVATION STANDARDS IN PORTIONS OF THE KELSEYVILLE COUNTY WATERWORKS DISTRICT NO. 3[1]

ORDINANCE NO. 2721

Ordinance Establishing Ordinance No. 2291 as the Water Conservation Standards Ordinance of the Kelseyville County Waterworks District No. 3, and Including This Ordinance in Appendix "E" of the Lake County Ordinance Code.

The Board of Directors of Kelseyville County Waterworks District No. 3, County of Lake, Ordains as Follows:

Ordinance 2291, entitled "An Ordinance Establishing Water Conservation Standards In Portions of the Lake County Sanitation District," adopted by the Board of Directors of the Lake County Sanitation District on July 11, 1995 and amended by Ordinance No. 2705, entitled "An Ordinance Amending Ordinance 2291 Establishing Water Conservation Standards for All Buildings Served by the Lake County Sanitation District," on November 2, 2004, is hereby established as the Water Conservation Ordinance for Kelseyville County Waterworks District No. 3 with the following changes hereinafter set forth in Section 2.

All references to Lake County Sanitation District shall mean Kelseyville County Waterworks District No. 3.

Sec. 2. - Applicability.

This ordinance shall apply to all buildings which are served by the District's facilities.

Sec. 3. - Definitions.

The following definitions are applicable to this ordinance:

(a)

Change of Ownership means a transfer of a present interest in real property, and a transfer of the right to beneficial use thereof, the value of which is substantially equal to the proportion of the ownership interest transferred. Every transfer of property shall qualify as a "change of ownership," except transfers of title which are exempt from property tax reassessment in accord with criteria used by the Lake County Assessor's Office in the implementation of California Constitution, Article XIII A, (i.e., transfers of title from one spouse to another) whether the transfer is voluntary, involuntary, by operation of law, by grant, gift, devise, inheritance, trust, contract of sale, addition or deletion of an owner, property settlement, or any other means. "Change of Ownership" affected other than by a contract of sale shall be deemed to occur at the time of actual transfer of title. A "Change of Ownership" resulting from a contract of sale or similar instrument shall be so regarded only if escrow is opened or a contract of sale is executed, whichever occurs last, on or after the effective date of this ordinance.

(b)

Change of Use means, in the case of commercial, industrial or public buildings, a change in the use to which the structure was previously devoted, to a substantially different use.

(c)

District means the Kelseyville County Waterworks District No. 3.

(d)

Existing Structure means any structure built and available for use or occupancy within one hundred twenty (120) days of the effective date of this ordinance.

(e)

Increase in Floor Area means an increase in conditioned space such as bathrooms, living rooms and bedrooms. Conditioned space means areas within the insulated envelope of a building in which heating and cooling systems are available to control the temperature of the area.

(f)

Low Water-Use Plumbing Fixtures means any toilet using a maximum of 1.6 gallons per flush, and shower heads designed to emit a maximum of 2.2 gallons per minute (gpm) of water.

(g)

Public Authority Structure means buildings which are owned by local public agencies.

Sec. 4. - Retrofit Upon Expansion, Change of Ownership or Use.

(a)

Mandatory Retrofit Upon Change of Ownership or Use. All plumbing fixtures in existing structures, including residential, commercial, industrial, and public authority structures shall, at the time of change of ownership or change of use, be retrofitted, if not already so, exclusively with low water-use plumbing fixtures as defined by this ordinance. These fixtures shall be installed and maintained, and shall not be replaced with fixtures which allow greater water use.

(b)

Mandatory Retrofit Upon Expansion of Use. All structures, including residential, commercial, public authority, and industrial reconstruction, remodels or additions that add any bathroom(s), and/or increase in floor area of existing structures by twenty-five (25) percent or greater of the existing floor area shall meet "New Construction" low water-use plumbing fixture standards as defined by this ordinance for the entire facility, including retrofitting of plumbing fixtures within existing structures. Additions not involving conditioned space such as porches and garages are exempt from an increase in floor area.

(c)

Retrofit Exemption.

(1)

Exceptions & meaning →

1.6 Gallon Toilets.

Previously installed toilets with fixtures using a maximum of 1.6 gallons per flush shall be

exempted from the provisions of this section.

(2)

Other. The Special Districts Administrator shall defer the retrofit requirement of this ordinance for any plumbing fixture for which present technology is not available to cause the required flow reduction, or where retrofitting is not otherwise technically feasible. When technically feasible, retrofit shall be required at the time technology becomes available.

(d)

Proof of Retrofit Upon Change of Ownership. Before the close of escrow for any change of ownership of real property within the District which is served by the District's wastewater collection and treatment facilities, the selling owner(s) or his authorized agent shall in the form and manner specified by the Special Districts Administrator, certify compliance with the retrofit requirements of this ordinance by one of the following methods:

(1)

Certification that the plumbing permit obtained in relation to plumbing fixture installation shows compliance with this ordinance. This certification shall be filed by the seller in the Lake County Special Districts Administration Office;

(2)

Certification by way of an inspection report, or other appropriate report (the Special Districts Administrator shall maintain a list of individuals qualified to provide this report) which verifies installation of low water-use fixtures throughout the structure as required by this ordinance. This certification shall be filed by the seller in the Lake County Special Districts Administration Office;

(3)

Certification by a building inspection by the appropriate City or County Building Official which verifies installation of low water-use fixtures throughout the structure as required by this ordinance. This certification shall be filed by the seller in the Lake County Special Districts Administration Office;

(4)

Certification that the plumbing fixtures throughout the structure have been retrofitted in compliance with this ordinance. This certification shall be filed by the seller in the Lake County Special Districts Administration Office along with a dated copy of the purchase receipt for each low water-use fixture, and a copy of the labor contract, or statement of self-installation, which evidences complete installation;

(5)

Waiver of proof of retrofit by the Special Districts Administrator before the close of escrow requirement of this section where the seller and buyer certify that the structure will begin to be remodeled or modified within one hundred twenty (120) days of the close of escrow, that the structure will be exclusively retrofitted with low water-use fixtures upon completion of construction, and the new owner shall allow inspection of the property by District staff or its authorized agent.

(e)

It shall be a violation of this ordinance for any buyer or seller to instruct an escrow agent to close escrow for any sale of property in the District served by wastewater collection and treatment facilities which does not comply with Subsection (d) of this section.

(f)

Subsection (d) shall not impose any affirmative or discretionary duty upon an escrow agent, acting in the capacity of escrow officer. Nothing in this ordinance shall be construed, either expressly or by implication, to provide for a criminal proceeding or create a civil liability against a title insurance company, as defined in Insurance Code Section 12340.10., or an underwritten title company, as defined in Insurance Code Section 12402, or their officers, directors, or employees, by reason of an alleged violation of this ordinance by a party or parties to an escrow at such a corporation.

(g)

Proof of Retrofit Upon Change of Use. Prior to the change of use of any residential, commercial, industrial or public authority structure, the owner of record or his agent shall certify in writing to the Kelseyville County Waterworks District No. 3 that prior to such change of use of the structure, the owner has complied with this ordinance, including all plumbing fixture retrofitting requirements. Change in use of such buildings made prior to submission of such written certification to the Special Districts Administrator shall constitute a violation of this ordinance.

Sec. 5. - Recordation of Notice.

Wherever the Special Districts Administrator determines that low water-use plumbing fixtures either have not been installed at the time of change of ownership or use, or when installed pursuant to the mandatory provisions of Section 4 have been removed since initial installation, the Special Districts Administrator may record a notice of violation with the office of the County Recorder. Before a decision is made to record a notice of violation, the owner(s) of the property will first be given notice and provided an opportunity to be heard on why a notice of violation should not be recorded. The owner(s) of the property, as revealed by the assessment roll on which the violation is situated and any other person responsible for the violation shall be notified of the recordation, if their address is known. The owner of record shall have ninety (90) days to take corrective action. Failure to take corrective action within ninety (90) days shall constitute a violation of this ordinance. The Special Districts Administrator shall cause a notice of correction to be recorded at such time as the property owner has established full compliance with the provisions of this ordinance.

Sec. 6. - Discretionary Exemptions.

The Special Districts Administrator may, at his/her discretion, exempt facilities from the provisions of this ordinance, or may impose reasonable conditions in lieu of compliance therewith, if he determines that any of the following sections apply:

(a)

Hardship. The Special Districts Administrator may grant all exemption for hardship where the requirements of this ordinance would cause an unnecessary and undue substantial hardship upon the owner, or purchaser of the facility, or the public. Substantial hardship may include, but is not limited to:

(1)

Plumbing in an existing facility which does not match connections with low water-using plumbing fixtures and would, therefore, require partial replumbing of the structures, (for example, different rough-in dimensions).

(2)

Unavailability of low water-using plumbing fixtures to match a well-defined historic architectural style (for example, Victorian, Mission Revival) in a locally, state or federally recognized building of historic significance, fitted with original plumbing fixtures.

(b)

Emergency. The Special Districts Administrator may grant an exemption for emergency purposes when the requirements of this ordinance would create a condition affecting the health, sanitation, fire protection or safety of the facility owner or the public. Emergency conditions include, but are not limited to, sewer line grades that are insufficient to accommodate reduced flows caused by conversion of toilet(s) to 1.6 gallon flush as determined by the Special Districts Administrator or appropriate city or county engineer.

(c)

In Lieu Compliance. The Special Districts Administrator may grant an exemption by imposing reasonable conditions in lieu of compliance with the requirements of this ordinance, where the conditions would not allow the quantity of water consumed by the facility to exceed the total water demand achieved if the low water-use plumbing fixture standards set by this ordinance has been used, and would not otherwise adversely affect service to any existing water consumer.

Sec. 7. - Appeals.

(a)

Content of Appeal. An appeal may be made to the Kelseyville County Waterworks District No. 3 Board of Directors by any public agency or person aggrieved by a decision of the Special Districts Administrator

pursuant to this ordinance. The appeal shall be made in writing and shall be filed with the Clerk of the Board of Directors and shall contain the following information:

(1)

The identity of the appellant and his interest in the decision;

(2)

The Special Districts Administrator's decision, or the conditions which are being appealed;

(3)

A clear, complete, but brief statement of the reasons why the appellant feels the decision or the conditions imposed were unjustified or inappropriate (this should include reasons the appellant disagrees with the findings of the Special Districts Administrator and specific facts in sufficient detail to notify interested persons of the nature of the appeal). The Board will not accept an appeal stated in generalities.

(b)

Acceptance of Appeal. An optional form for giving notice of appeal shall be provided by the Special Districts Administrator. The form need not be used if the notice of appeal is complete. An appeal shall not be accepted by the Clerk of the Board of Directors unless it is complete and complies with all requirements. The Clerk of the Board of Directors shall not accept a notice of appeal if it is obvious on the face of the notice that it is incomplete. If the Clerk of the Board of Directors rejects a notice of appeal, he/she shall inform the appellant of the nature of the deficiency, and shall identify the information necessary to complete the appeal.

Sec. 8. - Enforcement and Penalties.

(a)

The Special Districts Administrator shall be the officer primarily charged with enforcement of this regulation. All public employees of the Kelseyville County Waterworks District No. 3 who are vested with the duty or authority to issue permits or licenses, shall conform to the provisions of this ordinance, and shall issue no such permits or licenses in conflict with the provisions of this ordinance, and any such permits, licenses, or use, if issued in conflict with the provisions of this ordinance, shall be null and void.

(b)

A violation of any provision of this ordinance is a misdemeanor as set forth in Section 806 of the Sewer Use Ordinance.

Sec. 9. - Civil Nuisance.

(a)

Any building or structure set up, erected, constructed, altered, enlarged, converted, moved, maintained, sold, or the use of which is changed contrary to the provisions of this ordinance, and/or any use of any land, building, or premises, established, conducted, operated, or maintained contrary to the provisions of this ordinance, shall be hereby declared to be a violation of this ordinance and a public nuisance.

(b)

The Kelseyville County Waterworks District No. 3 may abate the public nuisance in accordance with the provisions and procedures of Chapter 13 of the Lake County Code pertaining to nuisance abatement which are hereby incorporated by reference as if fully set forth.

Sec. 10. - Remedies Cumulative.

The remedies available to the District to enforce the ordinance are in addition to any other remedies available under the District's Rules and Regulation, or any other state statutes, and do not replace or supplant any other remedy but are cumulative thereto.

Sec. 11. - Severability.

If any section, paragraph, sentence, clause, or phrase of this ordinance, is, for any reason, held to be invalid or unenforceable by a court of competent jurisdiction, such invalidity or unenforceability shall not affect the validity or enforcement of the remaining portions of this ordinance, or of any other provisions of the Kelseyville County Waterworks District No. 3's Rules and Regulations. It is the District's express intent that each remaining portion would have been adopted irrespective of the fact that any one or more sections, paragraphs, sentences, clauses, or phrases be declared invalid or unenforceable.

Sec. 12. - Codification.

The Board of Directors directs that this Ordinance be codified as Appendix E to the Lake County Code.

Sec. 13. - Effective Date.

This Ordinance shall be in full force and effective on August 10, 1995 for all those areas served by the Southeast Regional Wastewater Treatment Plant.

This Ordinance shall be effective on December 31, 1996 for those areas served by the Northwest Regional Wastewater Treatment Plant.

APPENDIX F - MANDATORY WATER CONNECTION TO COUNTY SERVICE AREA NO. 6, FINLEY WATER

Sec. 1. - Purpose and Findings.

It is the purpose of this ordinance to ensure that County Service Area No. 6 is able to provide sufficient drinking water that meets or exceeds all applicable state and federal water standards. In adopting this ordinance the Board of Supervisors make the following findings:

1.1

County Service Area No. 6 maintains water distribution facilities to provide water to all property owners within its boundaries.

1.2

County Service Area No. 6 incurs substantial expenses in the operation, repair, maintenance, construction and improvement of such water distribution facilities.

1.3

In order to finance necessary facility improvements required to maintain compliance with state and federal drinking water standards it has been necessary to obtain a loan from United States Department of Agriculture/Rural Utilities Service (USDA/RUS).

1.4

In order to comply with the USDA/RUS loan and grant conditions, the County is required to provide for mandatory water connection so as to ensure that all properties benefiting from facility improvements will contribute to their repayment.

Miscellaneous Charges.

a.

Late Charge - A late charge of $5.00 is due in the event that payment is not received within 30 days following the mailing of the notice that payment is due.

b.

Shut off and turn on charges:

(1)

A charge of $10.00 to shut off or turn on service made upon request of recipient of service.

(2)

A charge of $40.00 when the District is required to shut off service because of the failure to pay charges.

c.

Standby charges or availability charges:

(1)

A charge of $2.50 for each month on metered water service. These charges shall be due once every two months.

d.

Rental deposit - When service is made to property being rented or leased, the tenant shall be required to complete a renter's contract and deposit with the District the amount of $60.00. The deposit made pursuant to this provision is refundable to the depositor thereof, upon the complete payment by tenant of the closing statement of charges, or when the tenant becomes the legal owner of record, whichever occurs first.

e.

Loan repay - $7.66 per month per single family dwelling equivalent or $15.32 per single family dwelling equivalent per two-month billing. This fee is established pursuant to the provisions of the USDA Loan Agreement for improvements to Kelseyville County Water District #3, and it will become effective on 15, September, 2003.

f.

Water Hydrants:

(1)

A charge of $67.05, to set hydrant meter.

(2)

A base charge of $35.21 per month.

(3)

A charge of $2.26 for each 100 cubic feet per month.

(4)

Charges for water from water hydrants shall be due upon receipt of billing.

Line Connections.

a.

Metered Line Connections:

(1)

A charge of $350.00 for the installation of a water meter.

(2)

A charge of $200.00 for each additional meter installed on the same property and at the same time.

(3)

The cost for the installation of a water meter and tap to the main line is as follows:

(a)

A charge of $450.00 for five-eighths by three-quarter inch diameter meter.

(b)

A charge of $525.00 for one-inch meter.

(4)

A charge based on the cost of material and labor shall be due for any meter or meters or meter and taps not covered by the provisions of subdivisions (1), (2) and (3) above. Any person or entity requesting the installation of a meter or meters pursuant to this subdivision shall deposit the amount of $800.00 with the District. In the event that the total cost, as determined by the District exceeds said deposit, the deposit shall be credited to the total amount due for such costs. In the event that the total cost is less than such deposit, the difference between the deposit and the total cost shall be refunded within a reasonable amount of time of the completion of the work.

Capacity Expansion Fee.

a.

There shall be fees for any new construction or additions to existing structures and facilities in the following amounts after September 1, 2006:

1. Single family residence $2,500.00
2. Mobile Home $2,500.00
3. Multifamily housing units including but not limited to duplexes, four-plexes, apartment houses and condominiums. Charge is for each separate dwelling unit. $2,500.00
4. Motels, hotels, inns, auto courts and boarding houses. Charge is for each separate dwelling unit. $1,500.00
5. Manager's residential unit for motels, hotels, inns, auto courts, and boarding houses. $1,500.00
6. Commercial building. Charge is for each separate office, shop or other defined area subject to rental or lease. $1,500.00
7. Hospital, sanitarium, nursing home, convalescent home or maternity home. Charge is for each room intended to be occupied by patients or residents overnight. $1,500.00
8. Laundromat. Charge is for each washing machine. $2,000.00
9. Recreational vehicle park, campground, trailer park or other area utilized by recreational vehicles as defined by law per RV space. $1,000.00

b.

A fee for new construction or additions for human habitation not provided for herein shall be fixed by the Board of Directors of the Kelseyville County Waterworks District No. 3 on a case by case basis.
