Article VIII — PERMIT MODIFICATIONS AND TIME LIMITS

Sec. 30-32. - Modifications to approved permits.

32.1

The permittee of any valid grading permit may apply for an extension or modification of such permit. Any proposed changes to the approved grading permit shall be submitted to the Community Development Department for review. The application for said modifications shall emphasize the proposed changes. The permittee shall not undertake or allow activities to occur which do not conform to the plans or conditions of the approved grading permit. The Department shall review the proposed changes according to the same standards as and in the same manner as the originally submitted application.

32.2

Where conditions encountered in an approved grading permit activity differ from those anticipated or documented in the approved grading permit application, or where field conditions warrant changes in the recommendations in the original approved plans, revised plans shall be submitted to the Community Development Department for review prior to the implementation of such activities differing from the

approved grading permit application and plan. Significant changes may be subject to further review according to the California Environmental Quality Act (CEQA).

Sec. 30-33. - Effective date and expiration.

33.1

Grading permits shall become eligible for issuance on the day following the end of the appeal period for such permit. An approved grading permit shall be effective on the date of issuance and shall be effective for a term of two (2) years, unless suspended or revoked by the Administrative Official. The permittee may apply for an extension of the grading permit, if the application is received before the date of expiration. The Administrative Official may approve extension of a term not exceeding one (1) year.

33.2

The permittee shall fully perform and complete all of the work required to complete the activities associated with the approved grading permit application, project description, site plan and erosion control plan before the date of expiration on the approved grading permit.
