Chapter 30 — GRADING ORDINANCE

Sec. 30-29. - General.

29.1

Grading operations for which a permit is required shall be subject to inspection by the Administrative Official. Any other required professional inspection of grading operations shall be provided by a civil engineer, soils or geotechnical engineer or engineering geologist.

29.2

The permittee shall be responsible for the work to be performed in accordance with the approved plans and specifications and in conformance with the provisions of this Chapter, and the permittee shall engage consultants, if required, to provide professional inspections on a timely basis. The permittee shall act as a coordinator between the consultants, the contractor and the Administrative Official. In the event of changed

conditions, the permittee shall be responsible for informing the Administrative Official of such change and shall provide revised plans for approval.

Sec. 30-30. - Noncompliance.

30.1

If any of the professionals retained find that work is not being done in compliance with this Chapter or the approved plans, they shall immediately notify the Department and the permittee.

30.2

If an inspection finds that work is not being done in compliance with this Chapter or with the approved plans, the non-compliant work shall immediately be halted and the permittee shall submit to the Department a revised grading plan proposing corrective work or modifications to the approved plan. Those changes shall be approved before work shall resume.

Sec. 30-31. - Transfer of responsibility.

31.1

An approved grading permit shall not be transferable or assignable from one person to another, unless approved by the Administrative Official upon the receipt of a written agreement to comply with the terms and conditions of the approved grading permit from the person to whom the permit is transferred.
