10.41.010 - Definitions.

As used in this chapter regulating collection boxes, the following words shall have a meaning as defined in this section unless such meaning would be repugnant or inconsistent in the context used:

The word "collection box" shall include but not be limited to all of the following: collection boxes for newspapers, aluminum cans, or any and all usable or reusable goods.

10.41.020 - Procedure to obtain collection box encroachment permit.

(a) A collection box encroachment permit may be obtained from the city engineering department provided the following are satisfactorily established:

(1) The collection box owner shall be a nonprofit entity.

(2) A plot plan establishing the location of the collection box is approved by the city engineer.

(3) The applicant shall submit a plan showing the size, material, and color subject to the approval by the city engineer.

10.41.025 - Revocation of collection box encroachment permit.

(a) The city engineer shall revoke the encroachment permit if any one of the following acts or events occurs:

(1) The collection box and area around the collection box within twenty-five feet is not maintained in a litter-free manner.

(2) Name, address and phone number is not painted in white letters of two inches in height on the collection box.

(3) An individual is not designated as the entity's representative and has his name, address and phone number painted in white letters of two inches in height on the collection box.

(4) The following statement is not painted and maintained in white letters of two inches in height on the collection box: "This is not a City of La Mesa sponsored project."

(5) The collection box interferes with pedestrian and/or vehicular traffic.

(6) The collection box interferes with intersection visibility or creates any other traffic or safety hazards.

10.41.030 - Removal of collection box by city.

In the event said collection box is not being maintained in a litter-free manner and/or the name, address and phone number are not painted as set forth above, the city of La Mesa is and shall be authorized and empowered to remove said collection box should the owner not remove the box within forty-eight hours of notification, and collect the cost thereof from the owner, or the person with right of possession, the said owner and person with the right to possession shall be jointly and severally liable therefore. Said charges for removal of said collection box shall be billed to the owner of said collection box, and the person with right to possession of said collection box, by mail.
