10.12.010 - Declaration of public nuisance.

The council hereby finds and determines that entire communities within the city and a considerable number of citizens are adversely affected by persons throwing, casting, distributing, scattering, and depositing unwanted handbills, dodgers, circulars, newspapers, booklets, posters, printed matter, advertising literature and products, upon public and private property. Such acts are hereby declared to constitute a public nuisance.

10.12.020 - Public places.

No person shall throw, cast, distribute, scatter, deposit, or place upon any public place within the City, including, but not limited to, streets, alleys, public parks, and school grounds, any handbill, dodger, circular, newspaper, paper, booklet, poster, or any other printed matter, advertising literature or product of any kind; provided, however, the same may be personally delivered to persons who are willing to accept same.

10.12.030 - Automobiles.

No person shall throw, distribute, or place in or on any automobile or other vehicle in the City any handbill, dodger, circular, newspaper, paper, booklet, poster, or any other printed matter, advertising literature or product without first having obtained the permission of the owner or person in possession thereof.

10.12.040 - Private premises.

No person shall throw, cast, distribute, scatter, deposit, pass out, give away, circulate or deliver any handbill, dodger, circular, newspaper, paper, booklet, poster or other printed matter, advertising literature, or product of any kind in the yard or grounds of any house, building, or structure, on any porch, doorstep, or vestibule, in any public hallway or upon other private property unless: (a) the item so distributed displays the name, address and phone number of the entity causing said distribution; and (b) the distribu-tee owner, adult resident or occupant thereof wants said material. It shall be presumed that said material is wanted unless said distributee expresses orally or in writing to the entity causing said distribution that said material is not wanted.

10.12.050 - Permissible printed matter.

This chapter shall not be deemed or construed to prohibit or restrict the distribution of written or printed matter devoted to the expression of views, opinions, beliefs or contentions relating to religious, political or sociological subjects or to public or civic affairs, or to labor disputes or other controversies, or to community, state, regional, national or international affairs, or which treat of any social or economic order, or which relate to the arts or sciences; or which are aimed to redress any grievance, or which otherwise are not distributed for the purpose of soliciting business, trade or customers.

10.12.060 - Nonprofit events.

Nor shall the terms of this chapter be deemed to include the printed notice of an event which is not arranged for profit or to stimulate the business, trade, or traffic of the person who causes the dissemination of the notice, even though a monetary admission fee be requested or accepted in connection with such event.
