10.21.010 - Restricted use of skateboards, coasters, roller skates, etc.

(a) It shall be unlawful for any person upon roller skates or riding on or by means of a coaster, skateboard, toy vehicle or similar device to go upon the sidewalk in any business district within the city of La Mesa or upon any city roadway.

(b) No person shall ride any of the above-described types of devices or toys on any sidewalk in any other district in such a manner as to interfere with or prevent the lawful use thereof by pedestrians.

(c) It shall also be unlawful for any person to ride any of the above-described devices or toys within any public property, except within areas designated for such activities.

(d) It shall also be unlawful for any person to ride any of the above-described devices or toys within any privately owned property without written permission from the property owner.

10.21.020 - Ramps prohibited.

It shall be unlawful for any person to use, construct or place upon any public property a ramp, jump platform, rail, or similar device intended for use by a person upon a skateboard, roller skates or other similarly wheeled devices.

10.21.030 - Penalty.

A. Any person who violates a provision of this chapter is guilty of a misdemeanor.

B. The city attorney may request the performance of community service, as deemed appropriate by the court, for any minor determined to be a ward of the court under Welfare and Institutions Code Section 602 as a result of committing an offense enumerated in this chapter.

10.21.040 - Skate park regulations.

The purpose and intent of this section is: (1) to establish regulations for the use and enjoyment of a skate park area designated by the city council in the interest of public safety; (2) to comply with Health and Safety Code Section 115800 by adopting an ordinance requiring use of safety equipment and the posting of signs; and (3) to satisfy the conditions of Health and Safety Code Section 115800 for qualified immunity from liability for skateboarding as a hazardous recreational activity.

10.21.050 - Definitions.

For the purposes of this chapter only the following definitions shall apply:

(a) "Skateboard" shall mean a board of any material upon which any person may ride, which has wheels attached and such wheels may be used for moving or propulsion.

(b) "Skateboard park area" means that area in the city of La Mesa, California which is designated for use as a skateboard park by the city council.

(c) All other terms used in this chapter shall have the meanings assigned in common usage, except as otherwise defined by the Health and Safety Code or any other applicable law.

10.21.060 - Designation of skate park area and hours of operation.

The designated skate park area located in La Mesita Park shall operate during those hours and those days designated by the city manager or his/her designee.

10.21.070 - Rules for use of skate park area.

The following regulations shall be posted for public notice at the skate park area (the "designated skating area"):

(a) Skateboarding and in-line skating are hazardous activities;

(b) Skate at your own risk. Skateboards and in-line skates only;

(c) Skate park hours are dawn to dusk;

(d) No skateboarding or in-line skating on wet surfaces;

(e) Helmets, kneepads, and elbow pads required in the designated skate park area;

(f) Failure to wear helmets, kneepads, and elbow pads in the designated skate park area will subject persons to citation pursuant to Chapter 10.21 of the La Mesa Municipal Code;

(g) No skating on park curbs, parking lot, and entrance sidewalk;

(h) No graffiti or tagging;

(i) No glass bottles;

(j) Dispose of trash in trash receptacles;

(k) No smoking, alcohol, or drug use;

(l) No intimidation, hazing, or fighting;

(m) No spectators are permitted in the designated skate park area;

(n) No unauthorized pieces of equipment, obstacles, or apparatus may be brought into the designated skate park area;

(o) No food or drink allowed in the designated skate park area;

(p) No special events or contests are allowed in the designated skate park area unless authorized by the city of La Mesa. The city of La Mesa reserves the right to eject anyone from the skate park at any time for any reason.

10.21.080 - Hazardous recreational activity.

Pursuant to Health and Safety Code Section 115800, performing stunts, tricks or luge skateboarding in the designated area by persons age fourteen years and older shall be deemed a hazardous recreational activity within the meaning of Government Code Section 831.7 and the city shall not be liable for injuries incurred by persons participating in such activities.

10.21.090 - Posted signs.

(a) The city shall post an official sign at the entry of the designated skating area and additional signs therein as needed to provide reasonable notice of this section.

(b) The sign(s) shall provide notice to the public of:

(1) The regulations of Section 10.21.070 of this chapter;

(2) The caution: "Skateboarding is a hazardous recreational activity and the city shall not be liable for injuries"; and

(3) The caution: "Violators will be subject to citation, a monetary fine and removal."

10.21.100 - Record keeping.

The Public Works Parks Maintenance Division shall develop a system for recording skateboarding injuries occurring at the skateboard park and claims arising from its use and shall report those incidents to the judicial council in accordance with Health and Safety Code Section 115800.
