12.20.010 - Loitering after certain hours prohibited.

It shall be unlawful for any person to sit, lounge or remain in any public park in the city between the hours of ten-thirty (10:30) p.m. and six o'clock a.m. the next day.

12.20.020 - Littering parks.

It shall be unlawful for any person to drop, throw, deposit or leave any newspaper, lunchbox or other paper or box, or any scraps of food, peanut shells or other rubbish in any public park in the city unless the same is deposited in the rubbish or garbage receptacle intended to receive the same.

12.20.030 - Possession and consumption of alcoholic beverages in parks.

No person shall bring into any public park or public recreation area or possess or consume in any such park or recreation area any alcoholic beverage, with the exception of the Historical Park, without first having acquired a permit therefor from the city to be issued by the police department of the city, which permit shall define the manner, the particular conditions under which an alcoholic beverage may be brought onto, possessed and by whom consumed within such park or recreation area. "Alcoholic beverage" as the term is used in this section, includes alcohol, spirits, liquor, wine, beer and any liquid or solid containing alcohol, spirits, wine or beer and which contains one-half of one percent or more of alcohol by volume, and which is fit for beverage purposes either alone or when diluted, mixed or combined with other substances.

12.20.040 - Tobacco use in city parks.

No person shall use tobacco products of any kind, including, but not limited to, tobacco; cigarettes as defined as a rolled product for smoking of any size or shape that: is made of any tobacco, flavored or not, and has a wrapper made of paper or another material; all forms of cigars (including little cigars); smoking or pipe tobacco (including shisha); chewing tobacco and snuff; any product containing, made of, or derived from any amount of tobacco that is intended for human consumption; any product containing, made of, or derived from any amount of nicotine that is intended for human consumption and sold with or without a delivery device or system (for example, eLiquid with nicotine); electronic cigarettes or any device or delivery system sold in combination with nicotine for a single price; and any component, part, or accessory of an electronic cigarette that is used during the operation of the device when sold in combination with nicotine (for example, a battery used in the operation of the device sold with nicotine for a single price), in any city park. No person shall discard chewing tobacco, lighted or unlighted cigars or cigarettes or any tobacco product in any city park.

12.20.050 - Vehicles in parks.

Except for permitted loading and unloading, peace officer and city employees acting in the course of their employment, no person shall drive or convey any vehicle onto the park grounds except by permit issued by the community services department. For the purposes of this section, park grounds include all areas within all parks except for roadway and parking lots intended for public use.

All sections of the California Vehicle Code in effect in the city of Kingsburg shall be enforced in all city parks.

12.20.060 - Prohibition of glass containers at Crandell Swim Complex.

No person shall bring in, possess, carry, or use glass bottles or glass containers at the facility known as the Crandell Swim Complex.

12.20.070 - Park and recreation facility permit procedures.

A. A permit for the use of a park or recreation facility owned by or under the control of the city shall be required for the following uses:

  1. Exclusive use of a picnic pavilion or designated area of park for group picnicking activities;

  2. Exclusive use of the Crandell Swim Complex for group activities;

  3. Any group or organized activity of fifteen (15) or more persons.

B. Park Application and Use Permit. Whenever a permit is required, an application shall be filed with the city of Kingsburg stating:

  1. Name and address of applicant;

  2. The nature of the proposed activity;

  3. The date, hours, and the park facility for which the permit is desired;

  4. An estimate of attendance;

  5. The signing of a waiver of release holding the city, their officers, and employees harmless against any and all liability; and

  6. Any other information, which the city, regarding public health, safety and welfare, finds reasonably necessary to a fair determination as to whether a permit should be issued.

C. Permit Fees. The fees and charges for the use of city parks and recreation facilities shall be established by council resolution. The total amount of the fees due for the entire permit period shall be paid at the time of permit issuance.

D. Cancellation policy for parks.

12.20.080 - Golfing prohibited.

No person shall hit golf balls or practice balls, play or practice the game of golf in any city or public park.

12.20.090 - Enforcement.

The chief of police or its designee, is hereby authorized to enforce the provisions of this chapter in accordance with the applicable provisions of Chapter 17.92 of Title 17 of the Kingsburg Municipal Code."
