12.12.010 - Curbs and gutters required.

In addition to the requirements set forth in other parts of the Kingsburg municipal code requiring the installation of curbs and gutters in connection with the filing of a subdivision map, any owner of property within the city of Kingsburg prior to commencement of the construction of improvements on any unimproved property within the city of Kingsburg, and any owner of improved property within the city of Kingsburg, prior to remodeling the same or adding any structure to such improved property, shall be required at their own expense to install curbs and gutters on the public street abutting such property in the event such abutting street does not already have curbs and gutters installed, or in the event such existing curbs and gutters do not meet the standards set forth in this chapter.

12.12.020 - Permit required.

No person, firm or corporation shall commence street work on any subdivision, nor shall any such person, firm or corporation commence improvement of any unimproved property within the city of Kingsburg, nor shall any such person firm or corporation commence the remodeling of any improved property or any addition to such improved property without first obtaining a permit from the department of planning and development with respect to the construction of curb and gutter on the public street abutting such property as herein provided. The requirement for such permit shall not apply in the event such unimproved or improved property has existing curbs and gutters meeting the standard set forth in this chapter.

12.12.030 - Application.

An applicant for a permit hereunder shall file with the department of planning and development an application showing:

A. Name and address of the owner, or agent in charge, of property abutting the proposed work;

B. Name and address of the party doing the work;

C. Location of the work area;

D. Plan attached showing details of the proposed curb and gutter work to be done on the public street abutting such property;

E. Plan attached showing details of such proposed alteration or improvement; and

F. Such other information as the department shall find reasonably necessary in determination of whether a permit should issue hereunder.

12.12.040 - Prerequisites for issuance of permit.

The department of planning and development shall issue a permit hereunder when it finds:

A. That the plans for the proposed alteration or improvement have been approved by the department;

B. That the work shall be done according to the standards and specifications of the city for public work of like character;

C. That the driveway entrance for such proposed alteration or improvement does not unreasonably interfere with vehicular and pedestrian traffic, the demand and necessity for parking places, and the means of egress to and from the property affected and adjacent properties;

D. That the health, welfare and safety of the public will not be unreasonably impaired.

12.12.050 - Curb cut (drives) standards.

Curb cuts for driveway approaches shall be in accordance with the following standards:

A. No curb-cuts for a driveway shall be closer than five feet from the end of the radius return of the curb at intersections.

B. Driveway cuts for residential sites shall be of a maximum width of twenty-four (24) feet and a minimum width of twelve (12) feet. A curbed "island" between drives on the same property shall be a minimum of twenty-four (24) feet. The drive or curb cut width shall be measured along the inside sidewalk line and no more than forty (40) percent of the frontage shall be used for drives for vehicular access to each property.

C. Curb cut or drives in areas zoned for commercial use or industrial use shall not exceed thirty-five (35) feet in width nor shall more than fifty (50) percent of the frontage be used for drives or vehicular access to each property. A curbed "island" between drives on the same property shall be a minimum of twenty-four (24) feet.

12.12.060 - Abandoned driveway.

Where a curb has been cut for a driveway and later the use changes and the drive is relocated or is no longer in use, the property owner shall be required to remove said driveway and install a new curb.

12.12.070 - Repair of curbs and gutters.

All curbs and gutters shall be kept in repair by the property owners on which said curb and gutter fronts.

12.12.080 - Removal of buildings or curbs and gutters.

Upon the removal of any building from property, or upon the removal of any curb and gutter, any non-conforming curbs and gutters fronting on such property shall be replaced in accordance with this chapter.

12.12.090 - Deviation from curb and gutter standards.

The director of planning and development, with the approval of the city council, may grant permission to a property owner to modify the requirements as to the width and location of drive cuts as required in this chapter, provided there are unusual circumstances applicable to the specific property or due to unusual circumstances with respect to a particular existing street intersection.

12.12.100 - Inspection.

Prior to the pouring of any concrete for curbs and gutters being constructed pursuant to a permit issued by the city of Kingsburg, the holder of such permit shall give the city written notice of the fact that the forms therefore have been put in place and the pouring of the concrete therefore shall not be commenced until a representative of the department of public works has inspected such forms and authorized completion of such work.

12.12.101 - Enforcement.

The director of public works, or its designee, is hereby authorized to enforce the provisions of this chapter in accordance with the applicable provisions of Chapter 17.92 of Title 17 of the Kingsburg Municipal Code.
