12.08.010 - Permit required.

No person shall lay, make, or construct, or cause to be laid, made, or constructed, any sidewalk, curbing, or other street work or improvement in and upon any street, alley, or other public place within the city without a permit from the city.

12.08.020 - Application for permit.

Application for a permit shall be filed with the city, shall be in writing, and shall state the kind, character, location, and amount of work or improvement sought to be done; and shall be accompanied by a satisfactory guarantee that: the incidental expense of surveying and inspecting will be paid, that the work will be done in accordance with the specifications adopted by the city for the doing of such work, and that the work will be commenced within ten (10) days after the permit is issued and completed within such reasonable time as the superintendent of streets may designate.

Such application shall include a certificate of insurance reflecting liability insurance naming the city as an additionally-named insured in coverage and amounts acceptable to the city.

12.08.030 - Issuance of permit.

Upon the filing of an application and satisfactory guarantee, the city shall issue a permit for the work desired to be done; provided that no permit shall be issued by the city clerk for a less amount of work or improvement of any kind or for a less distance thereof than one block, except under the direction of the council.

12.08.040 - Grades for work.

No sidewalk, curbing or other street work or improvement shall be laid, made, or constructed in and upon any street, alley, or other public place within the city until the proper lines and grades shall have been determined and located and stakes set therefor by the city engineer. The charge set by the city engineer therefor shall be paid to the city by the person to whom the permit for the work was issued within thirty (30) days after the filing with the city of accounts of such charges by the city engineer.

12.08.050 - Acceptance of work.

No sidewalk, curbing, or other street work or improvement laid, made, or constructed, shall be accepted by the city unless the same was laid, made, or constructed in accordance with the specifications adopted by the city for doing such work, and no such acceptance shall be made by the city council until the incidental expenses of surveying and inspecting shall first have been paid; and no person having done or caused to be done any of such work, shall be entitled to collect from any property owner, his/her agent or assigns, any compensation for any part or portion of said work done until all of the incidental expenses of surveying and inspecting shall have been paid, and until the said work shall have been accepted in writing by the superintendent of streets. Such acceptance shall be notice to the property owner, his/her agent or assigns, that the work was done to the satisfaction of the city.

12.08.060 - Specifications.

Specifications for sidewalk, curbing, or other street work or improvement shall be established from time to time by the council by resolution; provided, however, except to the extent superseded by subsequently adopted resolution or resolutions, the provisions of the following ordinances, and the specifications contained therein, shall remain in full force and effect: Ordinance No. 66, adopted January 20, 1913; Ordinance No. 71, adopted June 30, 1913; and Ordinance No. 122, adopted December 18, 1922.

12.08.070 - Enforcement.

The director of public works, or its designee, is hereby authorized to enforce the provisions of this chapter in accordance with the applicable provisions of Chapter 17.92 of Title 17 of the Kingsburg Municipal Code.
