§ 8.41.010. Authorized billing.

All billing for garbage, recyclable material, green waste and organic waste collection shall be made by the city’s solid waste franchise hauler.

§ 8.41.020. Unpaid billing.

All billing for garbage, recyclable material, green waste and organic waste collection (“solid waste services”) shall become delinquent sixty days after the billing date.

§ 8.41.030. Notice of unpaid billing.

If a bill remains unpaid after the date of delinquency, the franchise hauler shall be entitled to a reasonable delinquency fee, in addition to other fees set forth in its agreement with the city. However, said delinquency fee shall not be assessed until fifteen days after notification of the delinquency to the recipient of solid waste services and the owner of the property receiving the solid waste services if they are different. The franchise hauler shall simultaneously submit written notice to the city stating the following:

(a) The assessor’s parcel number of the property to which solid waste services were rendered;

(b) Confirmation the delinquency notice has been sent to the recipient of solid waste services; and

(c) The date and address to which notice was sent.

§ 8.41.040. Assigning unpaid billing to city.

Upon expiration of the fifteen-day notice to the consumer, the franchise hauler may assign said bill to the city for special assessment proceedings.

§ 8.41.050. Responsible party.

Notwithstanding any provision in the King City Municipal Code to the contrary, a property owner shall be responsible for any unpaid billing for solid waste services assigned to the city by the franchise hauler. The city may place a special assessment on the property which received the solid waste services to recover the unpaid billing pursuant to the special assessment process provided in this chapter.

§ 8.41.060. Unpaid billing special assessment process.

Upon the city’s timely receipt of the assignment from the franchise hauler and at the convenience of the city, which shall be once per year, city staff shall initiate proceedings in compliance with Government Code Sections 38790.1 and 25831 to create a special assessment on the real property to which the solid waste collection services has been rendered.

§ 8.41.070. Additional fees subject to special assessment process.

The special assessment may carry additional administrative charges, including, but not limited to, attorneys’ fees, administrative costs and staff administrative time, incurred by the city to initiate and conduct the special assessment proceedings as required by this chapter.

§ 8.41.080. Notice of approved special assessment.

Once the special assessment has been approved, the property owner shall be notified by the city of the total special assessment amount, including any additional administrative fees and costs, which is due to the city and that the special assessment has or is going to be recorded against the property.

The special assessment will be officially recorded in the Monterey County recorder’s office.
