13.28.010 - Facilities regulated.

The camping areas covered by this chapter are the Tehachapi Mountain Camp; the Greenhorn Mountain Camp, consisting of the Lower Camp (Yenis Hante) and the Upper Camp (Kaweah); and the West Side Mountain Park, consisting of Camp Condor and the Lower Ski Hut.

13.28.020 - Charges for mountain group camp facilities.

In the campsites designated in Section 13.28.010 of this chapter, there shall be a charge paid by the groups or organizations using the same for each day of use, or fraction thereof. The fee shall be established by uncodified ordinance.

Camp Okihi is available for rental by adult groups only when not scheduled for school and other sanctioned youth organization activities. Sanctioned youth organizations may schedule Camp Okihi up to a year in advance. Adult groups may schedule Camp Okihi up to one (1) month in advance.

13.28.030 - Application and deposit of fee.

A. Application for use of such camp facilities shall be made upon such forms as shall be provided by the parks department; the application shall state the estimated number of persons expected to attend the period for which the permit is sought.

B. The application shall be signed by the applicant or its duly authorized officer or representative.

C. At the time of filing the application, or at least thirty (30) days prior to the date reserved, the applicant shall pay to the department the amount of minimum permit fee determined by the department as prescribed by Section 13.28.020 of this chapter, and such fee shall be nonrefundable.

13.28.035 - Security deposit

A. At the time of filing an application for the use of any of the camp facilities designated in Section 13.28.010 of this chapter, or at least thirty (30) days prior to the date reserved, the applicant shall deposit with the director of parks and recreation for the county a security deposit. The amount of the security deposit shall be established by uncodified ordinance.

B. Prior to refunding the security deposit, the director of parks and recreation shall deduct therefrom the cost of repairing or correcting any damage to the camp facilities which, in the opinion of the director, was caused by, or occurred during, the applicant's use of the facilities. In the event the camp facilities sustained no damage from or during the applicant's use, the entire amount of the security deposit shall be refunded. In the event the camp facilities have incurred damage in excess of the amount of the security deposit from or during the applicant's use, the entire amount of the security deposit shall be forfeited to the county and, in addition, the applicant shall pay to the county upon demand the difference between the actual damages sustained (as determined by the director of parks and recreation for the county) and the security deposit.

C. The director of parks and recreation of the county is authorized to waive or reduce the amount of the security deposit in charitable or needy cases.

13.28.040 - Permit issuance.

Upon the filing of the application and the payment of the minimum fee prescribed, a permit for the use of such camp facility shall be issued by the parks department in accord with the regulations established by it for the use of such camp facility.

13.28.050 - Statement of attendance—Balance of fee.

A. Not later than the tenth (10th) day following the period of use of the camp facility for which the permit was issued, the permittee shall file with the department a statement of the actual number of persons attending and pay an additional fee required.

B. Such statement shall be executed by the permittee or its duly authorized officer or representative in the manner prescribed by Section 2015.5 of the Code of Civil Procedure of the State of California.

C. No subsequent permit shall be issued to any applicant who has failed or refused to comply with the requirements of this section with reference to any previous permit issued to the applicant under the provisions of this chapter.

13.28.060 - Violation—Penalty.

Any person, firm, corporation or association using any of the premises concerned in this chapter and designated as a camp facility for which a charge shall be made without compliance with the provisions of this chapter shall be guilty of a misdemeanor and shall pay to the county for such use the sums prescribed by Section 13.28.020 of this chapter in addition to any fine or penalty imposed by the court upon conviction of such misdemeanor.

13.28.080 - Fee waiver.

The first twenty percent (20%) of the otherwise applicable fee for the use of Tehachapi Mountain Park may be waived by the parks director upon application, accompanied by any applicable filing fee, and upon his written finding that the requesting governmental entity, club, association, corporation, religious organization, or group either (1) for fund-raising activities, has the net proceeds serve solely charitable or broad-based community purposes, or (2) the applicant provides a recreational, athletic, or educational activity or other service that benefits the community, which is open to all persons on an equal basis, and no part of the earnings of which inure to the benefit of any private person or persons or for a political purpose which would cause an exempt organization to lose its exemption from taxation under federal or state laws. The director's decision may be appealed to the board of supervisors, upon a written appeal being filed with the department not more than ten (10) days after the director's written decision has been mailed to the applicant at the address shown on the application.
