13.24.010 - Charges for group picnic areas.

A charge shall be made for the use of group picnic areas as: Hart Park Section 7; Kern River Golf Course Rear Picnic Area; Stramler Picnic Area; and any other public park designated by the board of supervisors. The user of any of these picnic areas shall pay the charge for each day of use, or fraction thereof, the amount of which is dependent upon the number of persons irrespective of age using such area. The fee shall be established by uncodified ordinance.

13.24.020 - Application and deposit of fee.

A. Application for use of such picnic areas shall be made upon such forms as shall be provided by the parks and recreation department, the application shall state the estimated number of persons expected to attend the event for which the permit is sought.

B. The application shall be signed by the applicant or its duly authorized officer or representative.

C. At the time of filing the application, or at least thirty (30) days prior to the date reserved, the applicant shall pay to the department the amount of minimum permit fee determined by the department as prescribed by on Section 13.24.010 of this chapter, and such fee shall be fundable except as hereinafter provided in subsection (D) of this section.

D. Upon finding good cause shown by the written request for refund of permit fee filed by the applicant not less than sixty (60) days before the reserved date, the director of the parks and recreation department may refund the fee and reserve the use of such area to another applicant.

13.24.030 - Permit issuance.

Upon the filing of the application and the payment of the minimum fee prescribed, a permit for the use of such picnic area shall be issued by the parks department in accord with the regulations established by it for the use of such picnic area.

13.24.040 - Statement of attendance—Balance of fee.

A. Not later than the tenth day following the holding of the event for which the permit was issued, the permittee shall file with the department a statement of the actual number of persons attending the event.

B. Such statement shall be executed by the permittee or its duly authorized officer or representative in the manner prescribed by Section 2015.5 of the Code of Civil Procedure of the State of California.

C. If the number of persons attending the event as evidenced by the statement exceeds the estimated number of persons expected to attend the event, the permittee at the time of filing the statement shall pay to the department the balance of the fee prescribed by Section 13.24.010 of this chapter after crediting the fee paid by the applicant as prescribed by said section.

D. No subsequent permit shall be issued to any applicant who has failed or refused to comply with the requirements of this section with reference to any previous permit issued to the applicant under the provisions of this chapter.

13.24.050 - Closing hour.

The use of any picnic area designated under the provisions of this chapter shall close and terminate at the hour of ten (10:00) p.m. of each day.

13.24.060 - Violation—Penalty.

Any person, firm, corporation or association using any of the premises concerned in this chapter and designated by the board of supervisors as a picnic area for which a charge shall be made without compliance with the provisions of this chapter is guilty of a misdemeanor and shall pay to the county for such use the sums prescribed by Section 13.24.010 of this chapter in addition to any fine or penalty imposed by the court upon conviction of such misdemeanor.

13.24.070 - Lake Woollomes.

A. A limit on the number of vehicles allowed in the park will be established in order to prevent overcrowding. This limit shall be established by uncodified ordinance.

B. A charge for entry into Lake Woollomes will be in effect during times when the limit on the number of vehicles is in effect. The entry fee shall be established by uncodified ordinance.

13.24.080 - Westpark pool facility fees.

A fee for individual use of the Westpark swimming pool will be in effect for all persons who do not reside within County Service Area 63, Zone of Benefit 5 (CSA 63.5), also known as Westpark. There shall also be a charge for any group to rent the entire pool facility. CSA 63.5 residents may rent the pool facility for a fee which may be lower than the fee to be paid by nonresidents. Fees shall be established by uncodified ordinance.
