7.12.010 - Definitions

A. Bicycle means a device upon which any person may ride, propelled by human power, through a belt, chain or gears and having either two or three wheels in a tandem or tricycle arrangement. For the purpose of this chapter the term "bicycle" shall be limited to the above described devices having one wheel measuring at least 20 inches in diameter and a frame size of at least 14 inches.

B. New bicycle means a bicycle first sold as a new bicycle on or after the effective date of this chapter.

C. Old bicycle is a bicycle other than a new bicycle.

7.12.020 - License—Required

Except as hereinafter in this section provided, no person shall ride, operate or propel a new bicycle after the effective date of this chapter on any street, road, highway, sidewalk or established bikeway set aside for the exclusive use of bicycles or other public property within the city, unless such bicycle has been licensed and the license plate is attached thereto as provided for in this chapter.

7.12.030 - License—Application

Application for a bicycle license shall be made to the police department upon a form to be provided by the city. The application shall contain the name and address of the owner, the make, type, model and color of the bicycle, and its serial number, together with such other information as may be required by the chief of police or any governmental agency having jurisdiction.

7.12.040 - License—Examination

No bicycle license shall be issued unless or until the applicant shall have been examined to determine that he has a reasonable knowledge of the applicable provisions of the California Vehicle Code governing the operation of bicycles and of the provisions of this chapter. The type and manner of conducting such examination shall be prescribed by the chief of police and such examination may be conducted by any member of the police department.

7.12.050 - License—Duration

All licenses issued hereunder shall have a uniform expiration date. Licenses issued on or before December 31, 1978, shall expire on December 31, 1978. Licenses issued after December 31, 1978, shall expire at three-year intervals commencing December 31, 1981 and at the end of each three-year period thereafter.

7.12.060 - License—Fee

The license fee for each bicycle shall be $2.00 per year for each calendar year or fraction thereof between the time of the issuance of the license and the expiration date of the license issued. Said fee shall accompany each application. Fees for any new bicycle shall be due and payable on such sale and shall be delinquent if not paid within 30 days thereafter. Fees for the renewal of licenses issued hereunder shall be due and payable on the first day of January immediately following the expiration date of the license issued and shall be delinquent if not paid within 30 days thereafter.

All license fees collected under this chapter shall be delivered to the city treasurer and shall be deposited to a special fund of the city and shall be expended only for the purposes authorized by section 39004 of the California Vehicle Code.

7.12.070 - License—Transferability

Subject to the provisions hereof, licenses issued pursuant to this chapter shall be transferable. The owner of a bicycle licensed pursuant to this chapter, who sells or otherwise disposes of said bicycle, shall, within ten days, notify the city of such sale or disposition and the name and address of the person purchasing or otherwise acquiring said bicycle. Any person who purchases or otherwise acquires a bicycle shall, within ten days of taking possession thereof, apply for the transfer of the license to his name and shall furnish to the city the same information as in the case of an original application. An application for transfer shall be accompanied by a transfer fee in the amount of $1.00.

7.12.080 - License—Records

The city shall maintain records of each bicycle licensed hereunder, which records shall contain the name and address of the owner, the make, type, model and color of the bicycle, its serial number and the license number.

7.12.090 - License—Plates

Licenses issued pursuant to this chapter shall be evidence by an indica which shall be affixed to the frame of bicycle at such place as shall be designated by the chief of police, unless the department of motor vehicles shall issue regulations regarding the place where said indica shall be affixed, in which case such regulations shall control.

7.12.100 - License—Old bicycle

A. Old bicycles, licensed by the city on or before the effective date of this chapter shall be recognized as meeting the requirements of this chapter until December 31, 1978 and thereafter such bicycles shall be treated as having been first sold as a new bicycle on January 1, 1979.

B. Old bicycles which on the effective date hereof are not licensed, shall for the purposes of this chapter be treated as having been first sold as a new bicycle on the effective date of this chapter and shall be subject to the licensing and other provisions of this chapter.

7.12.110 - Prohibited acts

A. No person shall remove, destroy, mutilate or alter any license plate issued pursuant to this chapter.

B. No person shall ride or operate a bicycle upon any sidewalk except where it is designated as a part of a city bikeway. This does not prohibit a rider from crossing a sidewalk for the purpose of parking a bicycle as hereinafter provided, nor from dismounting and walking a bicycle upon a sidewalk, provided due care is exercised for the safety of pedestrians.

C. No person shall ride or operate a bicycle upon any city park or playground or upon any schoolground within the city so as to interfere with any activity being carried on therein.

D. No person shall park or leave a bicycle upon a sidewalk except in a bicycle rack or other facility intended to be used for the purpose of parking bicycles. If there is no such rack or facility upon the block where such bicycle is parked, it may be parked upon the sidewalk, provided it is in an upright position, does not interfere with pedestrian traffic, nor block any driveway, walkway or doorway.

E. No person shall construct or place a bicycle rack or other facility intended for the purpose of parking bicycles upon any city street or sidewalk without first obtaining a written approval therefor from the chief of police, which approval, if given, shall specify the design, type of construction and location of said rack.

F. Persons riding or operating a bicycle shall not ride more than two abreast.

Neither the parent of any minor nor the guardian of any ward shall authorize or knowingly permit such minor or ward to violate the provisions of this section.

7.12.120 - Impoundment

Bicycles which are not licensed pursuant to this chapter may be impounded by the police department. Any bicycle so impounded may be released to the owner thereof upon furnishing satisfactory proof of ownership, the licensing of said bicycle in accordance with this chapter and the payment of an additional fee in the amount of $5.00. If not so released within three months of its impoundment, it may be sold or disposed of according to law.

7.12.130 - Violation and penalty

Any person violating any provision of 7.12.110 of this chapter is guilty of an infraction and upon conviction thereof is punishable upon a first conviction by a fine not exceeding $50.00 and for a second conviction within a period of one year by a fine of not exceeding $250.00. Violation is not punishable by imprisonment.
