Sec. 6-7-201. - Authority of city to contract for and regulate removal.

The City Council may enter into one or more contracts for solid waste handling services for the collection, processing and disposal of solid waste generated at any premises within the City, and may establish rules for the regulation thereof as it may from time-to-time deem reasonable and necessary. The terms and standards set forth in this division shall be the minimum terms of any contract approved by the City Council.

Any contract for the collection and disposal of solid waste entered into by the City Council shall not be transferable unless prior approval is received from the City Council.

The work to be furnished under any contract by a contractor shall include the furnishing of all labor, materials and equipment necessary for the collection of solid waste pursuant to said contract.

Sec. 6-7-204. - Compliance with all laws including State mandated programs.

Any contractor granted a contract for solid waste handling services shall operate in a manner that complies with all State laws and regulations. This obligation shall expressly, without limitation, require contractors to provide all programs required by any State law or regulation to its customers, including, as applicable, programs that comply with recycling requirements and requirements related to the diversion of organic waste from landfills; and, further shall require contractors to operate such programs in a manner consistent with such law or regulation.

Sec. 6-7-205. - Contractor's vehicles.

A. Vehicles used by contractors in the collection and disposal of solid waste shall be approved by the City Manager and shall be in safe and operable condition. Vehicles used by contractors shall be painted with the firm name on each side in three-inch-high letters. No materials shall leak, fall or be spilled from any such vehicle or bin attached thereto. Contractors' vehicles shall be equipped with shovels and brooms to clean up spillage, and equipment bodies shall be of metal and watertight. Truck bodies will be closed when used to transport contents to places of disposal. The maximum gross weight imposed by the wheels of any one axle shall not exceed 20,000 pounds. Reference is hereby made to Chapter 2 of Division 8 of Title 6; which chapter is incorporated herein by this reference establishing the allowable exterior noise levels in the City of Irvine. Vehicles must conform to the California Vehicle Code and all other applicable laws and are subject to inspection by the City or the California Highway Patrol.

B. Each vehicle utilized by a contractor in the collection and disposal of solid waste must pass an annual City of Irvine vehicle inspection given by the Public Safety Department. Contractors' vehicles not passing either of the first two inspections shall be charged for total costs of the third and subsequent inspections. The Director of Public Safety is authorized to order that any vehicle which fails to pass three or more vehicle inspections not be utilized within the City for the collection or disposal of solid waste.
