Irvine Municipal Code Ch. 2 Miscellaneous

A. Encroachment upon or across public lands to build, construct, erect, place, add an opening, put up or maintain any building, structure, swimming pool, fence, wall, patio, trash or garbage receptacle or bin, or any other thing in or upon or adjacent to any park without having first obtained the prior written consent of the Administrative Authority is prohibited. In addition, no person shall place, file, deposit or leave any building material or any article or any other building devices upon any public lands.

B. Every person who encroaches upon, or pursuant to whose direction or authority, either as a principal, contractor or employer, causes encroachment upon any public lands, must erect and, so long as construction is under way, maintain appropriate barriers, barricades, traffic and warning devices as shall be required by the Director of Public Works.

C. Where work has been done in any park the permittee shall repair, reconstruct, and put the public land in as good condition in all respects when the permitted work shall have been completed or permission to use the public park has expired, as said public land was in when said permission was granted or said work commenced. The condition of the public land where any work has been done hereunder shall be made satisfactory to the Community and Library Services Department and the Public Works Department. City may require a performance bond to be posted prior to commencement of any construction. Said performance bond amount shall be determined by the appropriate City department. The performance bond shall be returned to the appropriate party upon satisfactory completion of construction activity.
