12.06.010 - Enforcement—Right of entry.¶
The chief of police or his designee (chief) is authorized and empowered to enforce all of the provisions of this chapter and for the purpose of securing enforcement thereof is given the right to enter upon any public or private property located in Howard Park to inspect such accommodations or installations thereon or therein that may be covered by the provisions of this chapter. The form permit issued hereunder shall be available for inspection at all times.

12.06.020 - Applicability of chapter.¶
The provision of this chapter shall be applicable to Howard Park.

12.06.030 - Specific acts prohibited.¶
Every person who willfully within Howard Park commits any of the acts set out in this section or violates any other prohibition in this chapter is guilty of an infraction or misdemeanor. The prohibited acts include the following:
A. To hitch, fasten, lead, drive or let loose any animal or fowl of any kind, except in areas which may be designated by the chief of police or his designee (hereafter "chief"), provided that this shall not apply to dogs and cats when led by a leash and under full control by its owner or custodian, and shall not apply to those dogs defined under California law as "assistance dogs."
B. To enter, remain, stay or loiter in any park or facility between dusk and dawn without permission from the chief or except as a participant in an activity permitted by the chief.
C. To light or maintain any fire or to cook, prepare, serve or eat any meal other than in an area which is provided for that purpose and designated as such by posted notice.
D. To possess within Howard Park any firearms, firecrackers, rockets, explosives or any other fireworks, air gun, bow and arrow, slingshot or any similar device or weapon; nor shall any person carry into or use any other object within a park with the intent of disturbing the peace of any person by means of noise or otherwise.
E. To drive, hit or putt any golf ball or to use any golf club in any park or upon any pathway or trail, except in such areas as may be designated by the chief for that purpose.
F. To cut, break, injure, deface or destroy any tree, shrub, plant, rock, building, cage, pen, monument, sidewalk or paved area, fence, bench or other structure, apparatus or property, or pull up, cut, take or remove any shrub, bush, plant or flower, or mark or write upon, paint or deface in any manner any building, monument, bench, sidewalk, paved area or other structure. This prohibition shall not apply to any employee or contractor of the city.
G. To cut or remove any wood, turf, grass, soil, rock, gravel, sand or fertilizer from a park or from any place within a park.
H. To camp or lodge therein except by permission in writing by the chief.
I. To throw, discard, place or dispose of any garbage or refuse in any place other than in a garbage can or other receptacle maintained for that purpose.
J. To hold any meeting, service, concert, event or exhibition without first obtaining written permission from the chief or other city official or department designated by the city manager for the issuance of such written permission.
K. To interfere with the use of any scheduled group or activity that has received a permit from the city for use of said park.
L. To camp overnight or otherwise set up camping equipment within a park without express written permission from the chief.

12.06.040 - Regulation of campsite activities.¶
It
shall be unlawful and an infraction for any person to do any of the following in Howard Park:
A. Designated Campsite Use. Camp in any area other than a designated campsite in accordance with Howard Park master plan.
B. Longevity of Stay. Remain in Howard Park campground after being directed to leave by chief.
C. Vehicle Parking. Park an unauthorized vehicle within the campground area. An unauthorized vehicle shall be defined as any vehicle not previously approved for parking within the campground area by the chief.
D. Appearance of Campsite. Leave a campsite without first having disposed of all trash in the nature of boxes, papers, cans, bottles, garbage and other refuse in a trash receptacle located within the campground. If no such trash receptacles are available, then refuse and trash shall be carried away from the campground by the camper to be properly disposed of elsewhere.
E. Use of Campground for Purposes Other than Recreation. Use of any area within the campground for purposes other than recreational camping activities or causal visitation to persons utilizing the campground for recreational camping purposes under this chapter.

12.06.050 - Prohibition against deposit of wastewater.¶
It is unlawful to deposit any wastewater, drainage or material from any camp car and/or trailer, on the surface of the premises of any camp space or other surface of Howard Park.

12.06.060 - Toilet facilities.¶
At least one toilet must be provided for each sex for every ten tents, camp cars and/or trailers or fractional part thereof. Event sponsors are responsible for this provision and failure to so provide will void permission to camp overnight.

12.06.070 - Prohibition on sound amplification.¶
No person shall operate a generator or sound amplification device including radio, television, tape or record playing device, or speaker system in the designated campground area, if such operation disturbs other campers.

12.06.080 - Prohibition against juvenile camping.¶
No person who is a juvenile shall camp in Howard Park camping area except as follows:
A. A juvenile who is accompanied by a parent or guardian.
B. A juvenile who furnished to the chief of police the written consent of and the full name, residence and the telephone of parent or guardian. Such written consent shall contain the inclusive dates applicable.
C. A juvenile who is part of a group permitted to camp in parklands at night and who is supervised by at least one adult responsible for each ten juveniles.
D. The term juveniles as used herein shall be construed to mean an unmarried person under the age of 18 years.

12.06.090 - Application for and approval of permit.¶
Any person and/or group applying for a permit to camp in Howard Park hereunder shall file an application, in the form and time schedule established by the city, for such permit with the city clerk. The application shall be considered by city administration who shall establish conditions as a part of the approval process, including conditions that all camping shall be related to an activity at Howard Park and for which appropriate insurance has been provided and that supervision will be provided. Following administration's approval, the chief of police may issue a permit for camping under the conditions imposed.

12.06.100 - Denial or cancellation of permit.¶
A permit shall be denied or cancelled if the proposed use or activities would:
A. Cause injury or damage to park resources; or
B. Be contrary to the purposes for which involved park areas were established, or unreasonably impair the atmosphere of peace and tranquility maintained in the park; or
C. Unreasonably interfere with other program activities at the park; or
D. Substantially impair the operation of public use facilities or services of concessionaires or contractors; or
E. Present a clear and present danger to the public health and safety; or
F. Result in significant conflict with other existing uses; or
G. Insurance or other permit conditions cannot be complied with the applicant.
