13.12.010 - Definitions.¶
As used in this chapter:
"For human consumption" includes the use of water where there is a likelihood of such water being ingested by human beings.
"Water containing excessive concentration of Fluoride" means water, the fluoride concentration of which is in excess of 1.4 milligrams per liter as determined by the county health officer.

13.12.020 - Prohibition against use for human consumption water containing excessive fluoride.¶
It is unlawful for any person, firm, corporation or public entity to appropriate, extract, divert, use, pump, or transport within the unincorporated territory of the county of Imperial water containing excessive concentrations of fluoride for purposes of human consumption within the county of Imperial or for the purpose of exporting to any other county, state, or nation for purposes of human consumption within such other jurisdiction.

13.12.030 - Public nuisance—Abatement—Penalty.¶
The appropriation, export, diversion, use, pumping, or transportation of water in violation of Section 13.12.020 is declared to be a public nuisance and shall be abated upon order of the county health officer. Any person, firm, corporation, or public entity who violates Section 13.12.020 after notice to abate is given by the county health officer is guilty of a misdemeanor and is punishable as prescribed by this code.

13.12.040 - Inspection by county health officer.¶
The county health officer and his or her authorized employees are empowered, at reasonable times, to enter upon any ground, within any structure or enclosure, or other place for purposes of making an inspection of any water works within the county of Imperial and to take samples of water from such works for purposes of determining whether such water contains excessive concentrations of fluoride whenever in the opinion of the county health officer or his or her authorized employee such water may contain excessive concentration of fluoride.

13.12.050 - Exception.¶
This chapter shall not apply to any water supply or water system for which a permit is in full force and effect issued pursuant to Section 116270 et seq. of the Health and Safety Code.
