13.08.010 - Short title.¶
This chapter shall be known and may be cited as the "Local Water Regulatory Program Fee Ordinance."

13.08.020 - Purpose.¶
The purpose of this chapter is to enact Imperial County policies requiring cost recovery for the administration and enforcement of a local water regulatory program as provided for in the California Health and Safety Code Section 116270 et seq.

13.08.030 - Definitions.¶
When the following words or phrases are used in this chapter, they shall have the meaning ascribed to them in this section.
"Community water system" means a public water system that serves at least fifteen (15) service connections used by yearlong residents or regularly serves at least twenty-five (25) yearlong residents.
"Local health officer" means a local health officer, appointed pursuant to Section 101000 of the Health and Safety Code, of a local comprehensive health agency designated by the board of supervisors, pursuant to Section 101275 of the Health and Safety Code, to carry out the drinking water program.
"Noncommunity water system" means a public water system that meets one of the following criteria:
Serves at least twenty-five (25) nonresident individuals daily at least sixty (60) days of the year, but not more than twenty-four (24) yearlong residents;
Serves fifteen (15) or more service connections and any number of nonresident individuals at least sixty (60) days of the year, but no yearlong residents.
"Nontransient, noncommunity water system" means a public water system that is not a community water system and that regularly serves at least the same twenty-five (25) persons over six months per year.
"Person" means an individual, corporation, company, association, partnership, municipality, public utility, or other public body or institution.
"Public water system" means a system for the provision of piped water to the public for human consumption that has fifteen (15) or more service connections or regularly serves an average of at least twenty-five (25) individuals daily at least sixty (60) days out of the year. A public water system includes the following:
Any collection, treatment, storage, and distribution facilities under control of the operator of the system which are used primarily in connection with the system;
Any collection, or pretreatment storage facilities not under the control of the operator that are used primarily in connection with the system;
Any person who treats water on behalf of one or more public water systems for the purpose of rendering it safe for human consumption.
"Service connection" means the point of connection between the customer's piping or ditch, and the public water system's meter, service pipe, or ditch.
"State small water system" means a system for the provision of piped water to the public for human consumption that serves at least five, but not more than fourteen (14) service connections and does not regularly serve more than an average of twenty-five (25) individuals daily for more than sixty (60) days out of the year.
"User" means any person using water for domestic purposes. User does not include any person processing, selling or serving water or operating a public water system.

13.08.040 - Local water regulatory program fees established.¶
A. Permit Application Fees. (In Addition to Annual Fees). Actual costs to be charged not to exceed the following amounts:

The above deposits are to be paid by an applicant at the time of plans for any type of review which in the discretion of the local health officer requires review by an engineer.

13.08.050 - Fee payment.¶
A. Prior to the issuance of any domestic water supply permit, the applicant shall pay to the Imperial County department of environmental health the annual fee(s) prescribed by the Imperial County board of supervisors. Application fees shall be paid upon submittal of an application. Application fees paid in excess of actual costs shall be refunded to the applicant, per Imperial County procedures for refund application and processing.
B. The amount of fees shall be determined by the fee standard in effect on the date of the payment.
