§ 10.59.010. Prohibition.

A. It is unlawful for any person to launch any ultralight vehicle from property owned or controlled by the City of Imperial Beach.

B. It is unlawful for any person to land any ultralight vehicle on property owned or controlled by the City.

C. It is an affirmative defense to a charge that a person has violated subsection B of this section that:

  1. The person needed to conduct a forced landing as described in the California Public Utilities Code;

  2. The application of this chapter is preempted by federal or state law;

  3. The person is landing at a lawfully-operating airport;

  4. The person is employed by a governmental entity and acting in the course and scope of their duties; and

  5. The person has the advance consent of the City Manager or designee. The granting of a business license, zoning permit, or any other permit or license does not constitute advance consent.

D. For purposes of this section, an "ultralight vehicle" is a vehicle so defined in Federal Aviation Regulation (FAR) Part 103 (14 Code of Federal Regulations Part 103) as it may be amended from time to time.
