1.20.010 - Public notice.

A. All Public Notices. Except as set forth in Section 1.20.020, all matters to be considered at a public hearing of the city council or other board, commission, committee, or agency of the town shall be noticed according to the provisions of this chapter. The posting on the town's three official bulletin boards of the agenda of the meeting at which the public hearing is to be conducted shall constitute posting of the public notice of such hearing as well. The procedures to be followed for all public notices shall be as follows:

  1. The appropriate member of the town's administrative staff ("staff member") shall prepare the public notice, which shall contain the date, time, and place of the meeting, the name of the municipal body before which the public hearing is to be held, and a general explanation of the subject matter of the public hearing.

  2. The staff member shall prepare the mailing list of the names and addresses of the persons to whom the public notice is to be sent. Such mailing list shall be either the type A public notice mailing list or the type B public notice mailing list, as described in this section. The choice of mailing list shall be as set forth in the provision of this code providing for the public hearing. In addition to the type A or type B names and addresses, the mailing list shall include the name and address of anyone who has requested notice, or who may, in the opinion of the staff member or in the opinion of any member of the body before which the public hearing is to be held, be significantly affected by the subject matter of the public hearing.

  3. The staff member shall prepare the public notice mailings, cause the public notices to be mailed via the U.S. Mail so that they will be postmarked at least fifteen days prior to the date of the public hearing, and file an Affidavit of Mailing.

B. Type A Notice Mailing List. The mailing list for type A notices shall contain the names and addresses of all owners of real property any part of which is located within five hundred feet (within three hundred feet, in the case of real property situated outside of the town) of the real property that is the subject of the public hearing.

C. Type B Notice Mailing List. The mailing list for type B notices shall contain the names and addresses of all owners of real property adjacent to the real property that is the subject of the public hearing.

D. Notwithstanding the provisions of subsections B and C of this section, if the owner of the subject real property also owns additional real property adjacent to the subject real property, the determination of owners entitled to notice shall be made using the outermost boundaries of the combined subject real property and adjacent real property, as if that boundary were the boundary of the subject real property. For purposes of this subsection D of this section, "adjacent" means any real property that is contiguous with the subject real property and any real property that is contiguous with such contiguous real property and so continuing until property is reached that is not owned by the owner of the subject property.

E. For purposes of this chapter, in determining what real property is "adjacent," public rights-of-way, including, without limitation, sidewalks, streets, alleys, driveways, and boulevards, and any vacated right-of-way the fee interest in which is still owned by the town, shall be disregarded, i.e., shall be treated as if the land on which they are situated is nonexistent.

1.20.015 - Number and location of official bulletin boards.

There are three official bulletin boards of the town, and the same shall be located in the town in the following locations:

A. One at the entrance of the Hillsborough Town Hall located at 1600 Floribunda Avenue;

B. One at 330 Ascot Drive (Fire Station 32);

C. One at 835 Chateau Drive (Fire Station 33).

1.20.020 - Notice regarding nuisances.

The notice provisions set forth in Chapter 8.16, Nuisances, shall apply to all matters covered by that chapter.

1.20.030 - When effective.

The provisions of this chapter shall apply to those portions of this code that specifically refer to Chapter 1.20. (During the two-year (1999-2000) process of updating the code, notice provisions in various titles of the code will gradually be converted to the Chapter 1.20 process.) Notice provisions in this code not referencing Chapter 1.20 shall continue to be in effect as stated until the chapter in which they appear is updated to refer to Chapter 1.20.
