1.01.010 - Adoption of Hillsborough Municipal Code, 1982 Edition.¶
Pursuant to the provisions of Sections 50022.1 through 50022.10 of the Government Code of the state, there is hereby adopted the Hillsborough Municipal Code, 1982 Edition, as published by Book Publishing Company, Seattle, Washington, including the following secondary codes incorporated by reference in whole or in part:
A. Code entitled "Uniform Building Code," 1967 Edition, Volume I, including the appendix thereto, published by the International Conference of Building Officials;
B. Code entitled "Uniform Building Code Standards For Volume I," 1967 Edition, published by the International Conference of Building Officials;
C. Code entitled "National Electrical Code," 1965 Edition, including appendices thereto, published by the National Fire Protection Association;
D. Code entitled "Uniform Plumbing Code," 1967 Edition, including the appendices thereto, published by the International Association of Plumbing and Mechanical Officials;
E. Code entitled "Uniform Building Code," 1967 Edition, Volume II, "Uniform Mechanical Code," published by the International Association of Plumbing and Mechanical Officials and International Conference of Building Officials;
F. Code entitled "Fire Prevention Code," 1953 Edition, published by the National Board of Fire Underwriters; and
G. Pamphlet entitled "National Board of Fire Underwriters Bulletin No. 266," published by the Committee on Fire Prevention and Engineering Standards; save and except those portions of the preceding secondary codes as are deleted, modified or amended by the Hillsborough Municipal Code.
From and after the effective date of this chapter the Hillsborough Municipal Code, 1982 Edition, shall constitute the penal and regulatory ordinances of the town.

1.01.020 - Table of contents, index headings and diagrams not part of code.¶
The table of contents appearing at the beginning of each title and chapter, as well as the tables and index in the back of the code; the title chapters and section headings are not adopted as part of the Hillsborough Municipal Code, 1982 Edition, but are included for convenience only. Said tables of contents, tables, index and title, chapter and section headings shall not be deemed to govern, limit or modify or in any manner affect the scope, meaning or intent of the provisions of any title, chapter or section.

1.01.030 - Effective date.¶
This chapter and the Hillsborough Municipal Code, 1982 Edition, shall become effective and in full force and effect at 12:01 a.m. on the thirty-first day after passage of the ordinance codified in this chapter.

1.01.040 - Repeals.¶
Upon the effective date of the ordinance codified in this chapter, the Hillsborough Ordinance Code shall be repealed.

1.01.050 - Supplements to Hillsborough Municipal Code, 1982 Edition.¶
Nothing herein contained is intended to affect the validity of any ordinance hereafter adopted amending the Hillsborough Municipal Code, 1982 Edition, which ordinances the city clerk is directed to cause to be incorporated in the Hillsborough Municipal Code, 1982 Edition, upon their respective effective dates. Upon the adoption of any amendment or addition to the code, or repeal of any of its provisions, the city clerk shall certify thereto, and maintain the same filed in her office and incorporate the same in the code in regular supplements.

1.01.060 - Constitutionality.¶
If any section, subsection, sentence, clause or phrase of the ordinance codified in this chapter or the Hillsborough Municipal Code, 1982 Edition, is for any reason held to be illegal, invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions. The council hereby declares that it would have passed the ordinance codified in this chapter and/or the Hillsborough Municipal Code and each section, subsection, sentence, clause and phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared to be illegal, invalid or unconstitutional.
