1.04.010 - Definitions.

The following words, terms and phrases whenever used in this code shall be construed as defined in this section unless from the context a different meaning is intended, or unless a different meaning is specifically defined, and more particularly directed to the use of such words, terms or phrases:

A. "City" or "town" means the town of Hillsborough, California, or the area within the incorporated territorial limits of the town of Hillsborough, and such territory outside the town over which the town has or may have jurisdiction or control by virtue of any constitutional provisions, or any law.

B. "City council" or "council" means the city council of the town of Hillsborough.

C. "Code" means the municipal code of the town of Hillsborough.

D. "Frontage" means the total length of a property line abutting a public or private right-of-way.

E. "May" is permissive.

F. "Must" is mandatory.

G. "Oath" means an oath or affirmation.

H. "Person" means a natural person of either sex, joint ventures, partnerships, firms, associations, corporations, business trusts, whether acting by themselves, or by servants, agents or employees. The provisions of this subsection shall be applicable as well to the servants, agents, managers, lessees, officers and employees of such person.

I. "Shall" is mandatory.

J. "State" means the state of California.

K. "Street" means a public or private thoroughfare (whether through street, dead-end street, or cul-de-sac, and including all roads, highways, drives, avenues, courts, lanes, ways, boulevards, alleys, places, terraces, and other public rights-of-way used by vehicular traffic) as commonly used to provide vehicular access to abutting property.

L. "Written" means and includes handwritten, printed, typewritten, mimeographed, multigraphed or reproduced by photography.

1.04.020 - Grammatical interpretation.

Unless otherwise specified in this code, the following grammatical interpretations shall prevail:

A. Genders. Any gender includes the other gender.

B. Singular and Plural. The singular number includes the plural; the plural includes the singular.

C. Tenses. Unless otherwise provided in this code, words, phrases or sentences used in the present tense include the past and future tenses; words, phrases or sentences used in the past tense include the present and future tenses; words, phrases or sentences used in the future tense include the present and past tenses.

1.04.030 - References to title.

Any reference in this code to an officer, employee, board, committee or ordinance, shall, unless otherwise indicated, mean the officer, employee, board, committee or ordinance, as the case may be, of the town of Hillsborough.

1.04.040 - Prohibited acts include causing and permitting.

Whenever in this code any act or omission is made unlawful, it shall include causing, allowing, permitting, aiding, abetting, suffering or concealing the fact of such act or omission.

1.04.050 - Civil code provisions adopted by reference.

The provisions of Sections 13 and 1645 of the Civil Code of the state are adopted in the interpretation of words and phrases, unless otherwise provided herein.

1.04.060 - Statutory references.

Unless otherwise herein indicated, reference in this code to statutes shall be to statutes of the state of California as such statutes were in effect on the effective date of this code.

1.04.070 - Authority to execute documents.

A. The positions listed in subsection (B) of this section are authorized to execute on behalf of the town any instrument described in California Government Code Section 40602 (a), (b), and (c), namely, all warrants drawn on the city treasurer, all written contracts and conveyances made or entered into by the city, and all instruments requiring the city seal. The authority granted herein shall be deemed to include the maximum allowed under the above cited code section and any successor provision thereto.

B. The positions referred to in subsection (A) are as follows:

City manager;

Assistance city manager;

City clerk;

Finance director;

Police chief;

Police captains;

Fire chief;

City engineer;

City planner;

Chief building official;

Public works director;

Public works superintendent; or

Any position that is the functional equivalent of any position listed above.
