Sec. 66-121. - Definitions.

The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

CalTrans means the department of transportation for the state.

Parade means any parade, march, ceremony, show, exhibition, pageant or procession of any kind, or rallies or demonstrations, or any similar display, in or upon any street, park or other outdoor places owned or under the control of the city.

Sec. 66-122. - Exemptions from article.

This article shall not apply to:

(1) Funeral processions supervised by a licensed mortuary.

(2) Picketing or other orderly processions on the sidewalks that do not violate any other state or city laws.

Sec. 66-123. - Permit required.

No person shall engage in, participate in, aid, form or start any parade unless a parade permit has been obtained from the city council.

Sec. 66-124. - Application for permit.

A person seeking the issuance of a parade permit shall file a written communication with the city manager. The city manager may require a police certificate of compliance.

Sec. 66-125. - Review of permit request.

Upon receipt of a parade permit request, the city manager shall forthwith refer the request to the chief of police, who shall make recommendation as to the time, place and manner of the parade and whether to issue or deny the parade permit, and specify the reasons for such recommendation. The city manager shall, upon receipt of such recommendation from the chief of police, refer the request to the city council as soon as reasonably possible.

Sec. 66-126. - Approval of permit.

Within 30 days of the city manager's receipt of a complete application for a parade permit, the city council will rule on such application, which may be denied, approved or approved subject to reasonable conditions. The council's consideration of the application may include but shall not be limited to the following:

(1) The best interest of the public's health, safety and general welfare as this relates to the application.

(2) Traffic circulation and regulation.

(3) Adequate police protection for the proposed parade and the remainder of the city.

(4) Whether the nature of the parade creates an unreasonable risk of harm to either the parade participants or members of the public.

(5) Whether the primary purpose of the parade is private gain as opposed to the general welfare.

(6) Whether the application allows sufficient time to properly protect the public interest.

(7) Adequate liability insurance to protect the city.

Sec. 66-127. - Permit fee.

Prior to issuance of any permit pursuant to this article, the applicant shall pay the fee prescribed by local law.

Sec. 66-128. - Parades on state highways.

In addition to the permit and fees otherwise required by this article, a permit from CalTrans shall be required for all parades wherein the route thereof will traverse any state highway within the city. An application to CalTrans for a permit to traverse a state highway within the city shall comply in form and content with its guidelines for such events, which may include but shall not necessarily be limited to appropriate approval by the city and the state highway patrol, and payment of appropriate fees.

Sec. 66-129. - Revocation of permit.

Violation of any term or condition of a permit issued under this article shall effect its immediate revocation, and the chief of police shall enforce the terms of this article to the same extent as if the permit had never been issued.

Sec. 66-130. - Street closure.

The chief of police shall have the authority, when reasonably necessary, to temporarily close a portion of any street for a parade, when in his opinion such closing is necessary for the safety and protection of persons who are to use that portion of the street during the temporary closing.

Sec. 66-131. - Violation of article; penalty.

(a) It shall be unlawful for any person to stage, present or conduct or attempt to stage, present or conduct a parade without first having obtained a permit therefor as provided in this article, or to otherwise violate any of the provisions of this article.

(b) It shall be unlawful for any person to participate in a parade on the city streets for which a permit has not been granted.

(c) It shall be unlawful for any person to fail to comply with all directions and conditions of the parade permit.

(d) Any person violating the provisions of any section of this article shall be deemed guilty of a misdemeanor, and upon conviction shall be punished in accordance with section 1-8.
