Sec. 38-1. - Desire of city to qualify to receive state aid.

The city declares that it desires to qualify to receive aid from the state under the provisions of Penal Code § 13500 et seq.

Sec. 38-2. - Adherence to state standards for recruitment and training.

The city, while receiving aid from the state pursuant to Penal Code § 13522, will adhere to the standards for recruitment and training established by the state commission on peace officer standards and training.

Sec. 38-3. - Adoption of specialized equipment use policy.

(a) Purpose and intent. The purpose and intent of this section is to comply with the statutory provisions of AB 481, codified as Government Code § 7070 et seq., relating to the acquisition of specialized law enforcement equipment, referred to by the state legislature as "military equipment" and its deployment by local law enforcement agencies.

(b) Adoption of specialized equipment use policy. The city council hereby approves the specialized equipment use policy on file with the chief of police.

(c) Findings. The city council adopts and incorporates the findings required by Government Code § 7071(d).

(d) Annual specialized equipment report.

(1) On an annual basis, but no later than March 31 of each year, the chief of police, or their designee, shall prepare a specialized equipment report that contains the information required by Government Code § 7072(a) for the previous calendar year.

(2) Within 30 days of the preparation of the specialized equipment report described in subsection (1) above, the chief of police, or their designee, shall cause to be held at least one public community engagement meeting to discuss the specialized equipment report. The public community meeting shall be noticed by the city clerk in the same manner as required for regular meetings of the city council and shall be held in a convenient location within the city.

(e) Publication. The chief of police, or their designee, shall cause the current specialized equipment use policy and the specialized equipment report to be made available on the city's website for public inspection.

(f) Renewal and amendments to specialized equipment use policy.

(1) Annual renewal. Each year no later than June 30, the chief of police, or their designee, shall submit the specialized equipment report described in subsection (d) above to the city council, along with either a renewal of the existing specialized equipment use policy, or an amended policy with proposed changes.

(2) Amendments. The chief of police, or their designee, shall submit any proposed amendments to the specialized equipment use policy to the city council prior to implementation.

(3) Renewal and approval of amendments. The items described in subsections (a) and (b) shall be submitted as a receive and file item at a regular meeting of the city council held pursuant to the Ralph M. Brown Act (Government Code § 54950 et seq.) where the opportunity for public comment is provided, no sooner than 30 days after the proposed renewal or amendment has been made available on the city's website for public inspection. If the city council takes no action on proposed renewal or amendment, then the specialized equipment use policy along with any amendments, shall go into effect immediately without further action of the city council and the findings described in subsection (c) above shall be conclusively presumed made by the city council.
