§ 5.55.010. Consolidated permit.

An entity that operates a farmers market pursuant to a community events permit issued to that entity pursuant to Section 9.39.040(C) of this code may choose to apply for a consolidated business license.

§ 5.55.020. Fee schedule.

The annual license fee for a consolidated business license issued pursuant to this chapter shall be the sum of: (A) the fee that would otherwise be due from the licensee pursuant to Section 5.48.010 of this code based on the licensee's own gross receipts; and (B) seventy-five dollars for each participant booth space authorized under the community events permit.

§ 5.55.030. Producers and vendors.

If the operator of the farmers market obtains a consolidated business license pursuant to this chapter, then each business that makes retail sales at an authorized participant booth shall be excused from obtaining a business license or paying a fee pursuant to this title. To the extent any such entity: (A) conducts business at the farmers market other than retail sales of agricultural products, flowers and plants, prepared food, and items incidental to food growing and gardening; or (B) conducts any business in the city outside of the farmers market, it must obtain a business license for such business activity as would otherwise be required by this title and pay the appropriate fee for that license.

§ 5.55.040. Division I applicable.

Except where explicitly provided by this chapter, a consolidated permit issued pursuant to this chapter, and the application for such permit and fees paid in connection with such permit, shall be treated as a business license issued pursuant to Division I of this title and shall be subject to the same procedures and requirements.

§ 5.55.050. Alternative procedure.

This chapter provides an alternative procedure for obtaining a business license to operate a farmers market. The operator of a farmers market may choose, instead, to obtain a business license pursuant to the general provisions of Title 5, in which event the operator will pay a fee based on its own gross receipts and each producer or vendor participating in the farmers market will need to separately obtain a business license.
