§ 5.26.010. Parking station defined.¶
For the purpose of this chapter, the term "parking station" means and includes any lot, parcel of land or premises where three or more vehicles are stored, kept or parked for the public in the open air, whether a charge is made for such parking or not.

§ 5.26.020. License fee.¶
Every person engaging in the business of operating a parking station wherein a fee is charged shall pay a license fee of twenty dollars per year or on gross receipts basis, whichever is greater.

§ 5.26.030. Permit required.¶
No person shall engage in the business of operating a commercial parking station without first obtaining a permit to do so from the director of licensing and code enforcement.

§ 5.26.040. Application for permit.¶
Applications for such permit shall contain, in addition to the information required by Section 5.06.020 of this code, a description of the property to be occupied by such business, the distance of such property from the nearest residence, court, apartment house or place of business, and a statement of the material to be used in paving the surface.

§ 5.26.050. Approval of application for permit.¶
Applications for such permit shall be referred to the building inspector for approval. Unless the parking station is located within a zone in which such place of business may be maintained and the surface thereof is or will be prepared in compliance with the provisions of this article, the application shall be disapproved.

§ 5.26.060. Necessity for paving and oiling—Maintenance.¶
No person shall maintain a parking station unless the ground surface used for the parking of automobiles is paved with a minimum of four inches of cement concrete or one and one-half inches of asphaltic concrete upon a two-inch base of gravel, decomposed granite or other material approved by the street superintendent. All such paving shall be maintained to the satisfaction of the street superintendent so as not to permit dust to rise and/or to be blown therefrom.

§ 5.26.070. Necessity for retaining wall.¶
Whenever the surface of any parking station is higher than adjacent improved property, there shall be constructed between the parking station and such adjacent property a cement curb or retaining wall at least six inches above the ground level.

§ 5.26.080. Minimum distance from residence.¶
No person shall maintain a parking station within six feet of any building or structure used for human habitation.

§ 5.26.090. Ingress and egress—Driveways.¶
No person shall move any vehicle in or out of parking station except over driveways, constructed in accordance with requirements approved by the building inspector.

§ 5.26.100. Trespass on adjacent property.¶
No person shall move any vehicle in or out of a parking station across the property lines of adjacent property without the consent of the owner thereof.

§ 5.26.110. Attendant required—Signs to be posted.¶
At each parking station where vehicles of the traveling public are stored by the hour, day or portion thereof, for a consideration, there shall be in charge and on duty during the hours the same is open for business at least one competent person, and there shall be installed and maintained thereon, at each entrance thereto the following signs plainly visible from the street:
A. A sign with letters not less than six inches high stating the time such parking station closes and indicating the time of day when there is an attendant on duty; and
B. A sign stating the parking fees charged therein, if the entrance abuts upon a street.

§ 5.26.120. Fire extinguishers required.¶
No person shall operate a parking station where an attendant is on duty without keeping a fire extinguisher, approved by the chief of the fire department, on hand at all times.
