§ 5.46.010. Permit required.¶
Garage or lawn sales shall not be permitted in this city unless a valid permit, as provided for in this chapter, has been obtained.

§ 5.46.020. Application.¶
Applications for permits shall be filed with the director of licensing and code enforcement. The application shall contain the following information:
A. The name and residence address of the applicant;
B. The business address of the applicant, including the name of his or her employer;
C. The period for which the permit is requested;
D. Description of all items to be sold, including serial numbers;
E. Such other information as the city may require.
The permit shall not be issued unless approval is obtained from the chief of police, fire chief, city attorney and city manager.

§ 5.46.030. Residential zones—Permit.¶
Garage or lawn sales, which are defined to mean the on-site sale anywhere in the premises of miscellaneous household items accumulated by the occupant of a residence as a normal matter of course, may be held in all residential zones, provided that a permit has been acquired from the director of licensing and code enforcement. The fee for such permit shall be set forth by resolution. Said permit shall be in force for a period of two consecutive days. Only two such permits may be issued to an individual and/or address during any calendar year.

§ 5.46.040. Residential zones—Requirements.¶
Persons conducting such sales in residential zones shall observe the following requirements:
A. Signs. No signs or devices used in connection therewith shall be placed on or in any public right-of-way.
B. Placement. No signs or devices advertising the sale shall be placed on any private property, except one double-face sign not to exceed five square feet in area (24? x 30?) on each face may be displayed at the site of the sale during the period of time that the garage sale permit is in force.
C. Permit to be Displayed. A copy of the garage sale permit shall be displayed at the site of the sale.
D. Serial Numbers. The serial numbers of all items which normally contain serial numbers, such as but not limited to typewriters, business machines, radios, television sets, record players and appliances, shall be given in writing to the chief of police before the application is approved.

§ 5.46.050. Commercial and industrial zones—Permit.¶
Garage and lawn sales, which are defined to mean the on-site sale anywhere on the premises of miscellaneous household items accumulated by the occupant of a residence as normal matter of course, may be held in all commercial and industrial zones, provided that a permit has been acquired from the director of licensing and code enforcement. The fee for such permit shall be set forth by resolution. Said permit shall be in force for a period of two consecutive days thereafter. Only one such permit may be issued to an individual and/or address during any calendar year. If said sale continues for more than two days thereafter, it shall automatically become a commercial activity and a business license must be obtained and all applicable city and state laws and regulations shall be observed.
