12.04.010 - Definitions.

Whenever any of the following names or terms are used in Ordinance No. 3597, the highway permit ordinance of the County, each such name or term shall be deemed and construed to have the meaning ascribed to it in this section as follows:

Board of Supervisors means the City Council of the City.

Building Code means the Building Code of the City.

Clerk of the Board of Supervisors means City Clerk of the City.

Commissioner or Director means the Community Development Director or his/her designee.

County, County of Los Angeles or unincorporated area means the City.

12.04.020 - Los Angeles County Code adopted by reference.

Title 16, Division 1 of the County of Los Angeles Code entitled "Highways" as that title currently exists, and/or as it may be amended from time to time by the County of Los Angeles, is adopted by reference, as the Highway Code of the City of Hawaiian Gardens.

12.04.030 - Rules and regulations.

A. Whenever street reconstruction has occurred within the 36 months immediately preceding a permit request, the permittee shall resurface the entire street within the limits of the longitudinal excavation.

B. Whenever street reconstruction has occurred within the last five years, but not less than three years preceding the permit request, the permittee shall resurface the half street within the limits of the longitudinal excavation.

C. Whenever a street is slurry sealed within the past one year immediately preceding a permit request, the permittee shall slurry seal the entire street within the limits of the longitudinal excavation.

D. Whenever a street is slurry sealed within the past three years but not less than one year preceding the permit request, permittee shall slurry seal the half street within the limits of the longitudinal excavation.

The above-noted provisions may be waived by the Community Development Director in cases in which the City Engineer has determined that there are exceptional circumstances warranting such a waiver.

12.04.040 - Construction without a permit.

Any work being commenced without obtaining proper permits from the Community Development Department shall be doubled. A maximum additional fee to be charged pursuant to this section for any such permit shall be $500.00. Payment of an additional fee pursuant to this section shall not relieve any person from fully complying with the requirements of this chapter.
