10.30.010 - Permit required.

No person shall hold, manage, conduct, carry on a block party or special event upon any public street or alley in the City without first having applied for and obtained a permit therefor from the City Administrator with the approval of the Sheriff's Department as provided in this chapter.

10.30.020 - Permit application—Contents.

Any person desiring to do any of the acts specified in Section 10.30.010 shall file an application with the City Administrator's office upon a form to be supplied by the City to the applicant setting forth the following information at least 20 working days before the proposed event:

A. The name and address of the applicant;

B. The purpose;

C. The date and time;

D. The place and plan;

E. Evidence of notification/authorization from homeowners/tenants on both sides of the street facing the block;

F. Insurance criteria. Liability may be required, which policy includes the City, its Board, officers, agents and employees as named or additional named insureds or providers the coverages that the City Administrator determines to be necessary. In making such determination, the City Administrator shall consider (1) whether there is a prior history of injury to persons or property when this group engages in expressive activity; (2) whether there is a prior history of injury to persons or property when similar groups engage in expressive activity; (3) the history scope of the risk and whether it exceeds the minimal or inconsequential; (4) whether the risk can be lessened or eliminated by adjusting the time, date, place or planned manner of expression; and (5) if so, whether the applicant is willing to make such adjustments;

G. Evidence of Fire Department notification;

H. Evidence of engaging security services; and

I. Payment of fees as may be set by resolution of the City Council.

10.30.030 - Permit application—Action.

All applications filed pursuant to Section 10.30.020 shall be acted upon by the City Administrator's office within ten working days from the date of filing. The City Administrator shall refer the application to the Sheriff's Department for review and recommendation.

10.30.040 - Permit application—Appeal—Issuance.

A. In the event the application is denied or the applicant objects to a proposed condition of the permit, applicant may file with the City Administrator's office a statement and the reasons why it is believed the City Administrator acted improperly. The City Council at its next regular meeting held after the date on which such appeal is filed or as soon thereafter that the matter may be placed on the City Council agenda, with the City Administrator's office, shall hear the appeal.

B. Should the City Administrator after investigation of the applicant and the facts contained in the application determine that the applicant has stated true facts in his/her application and the event as proposed will not interfere unduly with the use of the streets and will not tend to cause a breach of the public peace, he/she shall issue a permit, with the approval of the Sheriff endorsed thereon, designating the time and place of such event and the conditions of approval.

C. The City Council may adopt, by resolution, rules and regulations pertaining to the closure of streets for the purpose of block parties and similar events.
