Guadalupe Municipal Code Ch. 2.44 Redevelopment Agency

There exist within the City deteriorating areas, as defined in Chapter 1, Article 3 of Part 1, Division 24 of the California Health and Safety Code, known as the Community Redevelopment Law, and more specifically blighted areas as delineated by factors set forth in Sections 33031 and 33032 of the California Health and Safety Code.

Section 33100 of the Health and Safety Code created in the City a public body, corporate and politic, for the purpose of exercising the powers granted by the Community Redevelopment Law, but provided, pursuant to Section 33101 thereof, that such public body, corporate and politic, shall not transact any business or exercise any powers unless, by ordinance, the City Council declares there is a need for such agency to function.

The City Council finds that the action of declaring itself to be the redevelopment agency will serve the public interest and promote the public health, safety and general welfare in an effective manner, in that the City Council members are elected by the people and constitute the legislative body of the community, and as such are familiar with and responsive to the physical, social, economic and other needs of the community.

It is hereby found and declared, pursuant of Section 33101 of the Health and Safety Code, that there is a need for the redevelopment agency created by Section 33100 of said Law to function in the City, and such agency is hereby authorized to transact business and exercise its power under the Community Redevelopment Law of the State (Health and Safety Code Sections 33000 et seq.).

Pursuant to the provisions of Section 33200 of the Health and Safety Code, the City Council hereby declares itself to be the redevelopment agency, to be known as "the Redevelopment Agency of the City of Guadalupe," and all functions, rights, powers, duties, privileges and immunities vested by the Community Redevelopment Law in such agency shall be and are vested in the body.

The City Clerk shall cause a certified copy of the ordinance codified in this chapter to be filed in the Office of the Secretary of State of California.

The City Clerk shall certify to the passage and adoption of the ordinance codified in this chapter, and shall enter the same in the book of original ordinances of the City.
