§ 2.28.010. Recreation programs generally.

The City Council may hereafter organize, promote and conduct programs of community recreation, may establish a system of playgrounds and recreation and may acquire, improve, maintain and operate recreation facilities within or without the territorial limits of the City, and to these ends may make expenditures from the general fund of the City.

§ 2.28.020. Recreation Director—Appointment—Powers and duties.

The City Administrator may appoint a Recreation Director and such number of assistants as he or she shall from time to time deem necessary, at salaries or wages to be fixed by resolution of the City Council. A Recreation Director so appointed shall at all times be under the direction and control of the City Administrator, and shall have charge of all recreation equipment, buildings and playgrounds, and shall have such other and further duties as the City Administrator may from time to time direct; provided, however, that in such matters, the City Council may by motion override the will of the City Administrator. Assistants so appointed shall be under the direction and control of the Recreation Director, and shall have such duties as he or she may prescribe. Any Recreation Director or assistant may be appointed on a full-time or part-time basis, and may be otherwise employed by the City.

§ 2.28.030. Athletic contests, demonstrations or exhibits.

Athletic contests, demonstrations or exhibits, and other educational contests, demonstrations or exhibits, may be held from time to time; provided, that no such contests, demonstrations or exhibits may be held for which an admission fee is charged, unless the same are amateur and noncommercial.

§ 2.28.040. Permits for use of recreation facilities.

Any lodge, church, club, society, union, or other organizations not created for purposes of profit, or any other group of individuals, may obtain a permit for the use of any portion of any recreation facilities, whether real or personal property, of the City, for the purposes provided in this chapter in the following manner, and none other. Any such organization shall submit a petition in writing to the City Administrator stating the time at which such use is desired, the portion of the recreation facilities desired, the nature of the use for which it is desired, and whether an admission price is proposed to be charged, and if so what. The City Administrator shall then investigate the facts of the matter. If no admission price is proposed to be charged, the City Administrator may grant or refuse a permit in his or her discretion, and may grant a permit upon any condition which he or she deems necessary. If an admission is proposed to be charged, the City Administrator shall submit a written report and recommendation to the City Council, which may accept, reject or modify such recommendation in whole or in part, in its discretion, and may direct the Recreation Director or, in case none has been appointed, some other proper person to issue a permit to the party or parties submitting the petition, and may, as a condition precedent to the granting of such permit, require a sufficient security, in cash or otherwise, to reimburse and indemnify the City for the cost of lights, cleaning, repairs and other expenses arising from the use of such facilities under such permit, and may grant a permit upon any other condition which it deems necessary.

§ 2.28.050. Eviction of certain persons authorized when.

Any person upon any premises of the City, maintained under the provisions of this chapter, whether as a participant in any contest or exhibition, or as a spectator, or in any other capacity, and whether he or she is present thereon under a permit granted under Section 2.28.040, and whether he or she has paid an admission fee or not, shall be a mere licensee only, and may be evicted by any police officer of the City, or by the Recreation Director, upon return to him or her of any admission price which he or she has paid.
