2.40.010 - Adoption of city personnel regulations.

A.

Pursuant to the authority provided under Article VIII, Section 3 of the city Charter, the city council hereby establishes a compendium of personnel regulations which shall be a part of the city's administrative policy and procedure manual. The city council shall adopt general personnel policies by ordinance, resolution or minute action. The city council may adopt specific regulations implementing these policies and may include further delegation of development of implementing rules to the city administrator and/or department heads.

B.

All such regulations of the city council generally governing city personnel and any administrative rules adopted thereunder by the city administrator or department heads shall be placed in the city's administrative policy and procedure manual which shall constitute the compendium of personnel regulations. It is intended that these personnel regulations be a comprehensive and unified guide to all city personnel rules, together with the civil service rules and regulations of the personnel commission and any memorandums of understanding (MOU).

C.

All personnel ordinances, resolutions and other policies proposed to be adopted hereunder which affect the classified service of the city shall first be submitted to the personnel commission for review and comment and as appropriate to employee association or union representative(s) for review and comment prior to adoption, except in an emergency situation where time does not permit such review. Matters adopted under an emergency are temporary and will expire one hundred twenty days from adoption unless submitted to the personnel commission for review and comment and as appropriate to employee association or union representative(s) for review and comment. Memorandums of understanding with employee bargaining units shall be made available to the personnel commission upon request and may be referred to the commission at any time for review and comments.

D.

Each department head shall have power to prescribe and enforce reasonable rules and regulations not inconsistent with the Charter or ordinances of the city, or general laws of the state, for the conduct of the employees of the department of which he is in charge, for the distribution and transaction of its business and for records and property under his control. Such rules and regulations will be maintained in a departmental manual available to employees. Rules and regulations that expand or enhance general or city-wide rules and regulations are to be reviewed by the city administrator and legal review as necessary.

2.40.020 - Employee performance appraisal policy.

It is the policy of the city that performance appraisals shall be prepared for all regular city employees. Such performance appraisals shall be done on a regular basis, but not less than annually. No merit increases shall be awarded without the completion of a performance appraisal with the result that justifies the merit increase or as may be provided in an adopted MOU.

2.40.030 - Attainment of permanent employment status.

Except as otherwise required by the city Charter, other law, or MOU, no probationary employee shall attain permanent status until:

A.

The position has been authorized and funded by the city council;

B.

His/her supervisor conducts a final formal evaluation and finds that the probationary employee has performed satisfactorily in the position;

C.

The department head submits to the city administrator a personnel action form with proper approvals and documentation showing that the employee has successfully completed the probationary period to be processed placing the employee in permanent status; and

D.

The request is approved by the city administrator.

2.40.040 - Employee personnel records.

It is the policy of the city that personnel records of city employees be maintained in an organized, up-to- date and confidential manner, in compliance with all applicable laws and regulations. The city will have adopted policies in place regarding the management of personnel records.
