Chapter 2.32 — PARKS AND RECREATION COMMISSION

2.32.010 - Established.

There shall be a parks and recreation commission for the City of Grass Valley. The commission shall consist of five regular members and one youth alternate. The youth alternate shall be a youth between the ages of fourteen and twenty-one years.

2.32.020 - Term of office.

All members of the commission shall be appointed by the mayor with the consent by majority vote of the city council. Initial appointments shall be made not later than January 1, 1999, and shall be for the following terms: two for a two-year term and three for a four-year term. Thereafter, all appointments shall be for four- year terms and shall expire four years from the date of appointment. The youth alternate shall serve a two- year term. Members shall serve until their successors have been appointed and duly qualified.

2.32.030 - Members—Vacancy or removal.

With appointments, due consideration should be given to having wide range of interests on the commission, such as, but not limited to, forestry, arboriculture, landscaping, recreation, sports, etc. All members serve at the pleasure of the city council. Any member may be removed by majority vote of the city council. If a vacancy occurs other than by expiration of term, it shall be filled in the same manner as an initial appointment for the unexpired portion of the term.

2.32.040 - Chairperson, secretary and staff.

The commission shall elect its chairperson and vice-chairperson from among its members. The director of public works shall serve as secretary and provide necessary staff. The terms of the chairperson and vice- chairperson shall be for one year and shall commence January 1st of each year, completing the term on December 31st of that same year.

2.32.050 - Meetings.

A.

The parks and recreation commission shall hold regular meetings at such places and such times as approved by resolution of the commission. The commission may hold special meetings in accordance with the provisions of the Brown Act. All business conducted at meetings shall be approved by at least an affirmative vote of three members.

B.

The parks and recreation commission chairperson shall appoint, subject to the approval of the commission, such committees among the members as he or she deems fit.

C.

Any member of the commission who is absent without cause from two consecutive regular meetings, or from more than four meetings in any twelve-month period, shall be deemed to have abandoned membership. The secretary shall immediately advise the commission and notify the city council of such absences with a statement of the need to declare such office vacant and appoint a new member. A member is not absent without cause if the member provides the secretary with a written notice of absence in advance of the meeting, along with a statement of the cause which is satisfactory to the commission.

2.32.060 - Coordinating duties.

The parks and recreation commission may adopt from time to time such rules and procedures as it may deem necessary to properly exercise its functions. Such rules shall be prepared and recommended by the director of public works and are subject to appeal to the city council, whose determination is final. All such rules shall be kept on file with the chairperson of the board, the director of public works and the city clerk. A copy thereof shall be furnished to each commissioner, council member and any other person upon request. The chairperson of the parks and recreation commission is authorized and empowered to call upon or receive from any council member, city employee or any other qualified person, information and advice to effect the general purposes of this chapter. Should it be necessary to employ for compensation any services pursuant to this chapter, the chairperson shall submit a report of facts outlining the proposed services to the city council through the director of public works for consideration of such expenditure. The director of public works will work with the commission to annually prepare and submit a proposed budget for parks and recreation, including the commission's activities.

2.32.070 - Effect.

Nothing in this chapter shall be construed as restricting or curtailing any of the powers of the city council or city officers, or the delegation to the parks and recreation commission of any authority or discretionary powers imposed by law in such council or officers.

2.32.080 - Recommendation to council—Duties and responsibilities generally.

The parks and recreation commission may make such recommendations to the director of public works and/or the city council as it deems necessary concerning the organization, promotion, conduct and management of programs of community recreation in the city and the establishment of systems of parks, playgrounds and recreation and the acquisition and improvement of recreation facilities within or without the territorial limits of the city. The parks and recreation commission shall have the power and authority to

hold public meetings, studies and surveys for the purpose of securing facts and data concerning the matters enumerated in this section. The parks and recreation commission shall have only such powers as are expressly granted by this chapter or by motion of the city council.

2.32.090 - Duties and functions.

The powers and functions of the parks and recreation commission shall be as follows:

A.

To hold meetings on matters pertaining to planning and development of parks, cultural activities, historical resources, recreation and capital expenditures related to community park and recreation activities and facilities;

B.

To conduct such other meetings as are necessary and in accordance with its own rules and regulations;

C.

To report its decisions and recommendations in writing to the city council and director of public works;

D.

To consider, formulate and propose programs, activities, resources, plans and development designed to provide for the future growth and development of the community parks and recreation system;

E.

To make studies and reports for future acquisition of park and recreational sites;

F.

To make any and all recommendations to the city council and director of public works relating to the above matters, including the extension or reduction of the parks, recreation system and community activities to all areas of the city;

G.

To approve plans for the development of parks and programs for recreation within the budgeted funds adopted by city council.
