2.34.010 - Established.¶
A personnel commission is hereby established pursuant to Article IX, Section 3 of the Grass Valley Charter.

2.34.020 - Composition, appointment, terms of members, chair.¶
A.
The commission shall consist of five members appointed by the city council. No commissioner, nor any member of a commissioner's immediate family, may otherwise be a compensated officer, agent or employee of the city.
B.
Commissioners shall serve four-year terms of office and shall serve until their successors have been appointed and duly qualified.
C.
By a four-fifths vote, the council may remove a commissioner for malfeasance, neglect of duty or inefficiency.
D.
The commission shall annually elect one of its members to serve as chair.

2.34.030 - Powers of the commission.¶
A.
The commission shall act as an independent agency of the city to ensure the proper and impartial functioning of the civil service system and to advise the council and city manager on matters relating to the civil service system. The city council may assign other duties to the commission from time to time. The commission shall fulfill any other responsibility assigned to it pursuant to a memorandum of understanding bargained for pursuant to the Meyers-Milias-Brown Act.
B.
Commission meetings shall be held on a regular basis as the chair or a majority of the members determine. Such meetings shall be open to the public, except as to those matters which are authorized by law to be conducted in closed session.
C.
The commission shall hear appeals of employees within the civil service pertaining to grievances and disciplinary action involving suspension, demotion, termination, fining, or other substantial penalty as provided by this code. "Substantial penalty" means a suspension without pay of two weeks or more.
D.
Unless a specific term in a memorandum of understanding bargained for pursuant to the Meyers-Milias- Brown Act provides otherwise, the commission may delegate to the personnel officer the hearing of employee appeals of discipline which do not involve a substantial penalty as defined in paragraph C., above.
E.
The determination of such appeals by the commission or the personnel office, as the case may be, shall be final but subject to judicial review pursuant to California Code of Civil Procedure section 1094.5.

2.34.040 - Staff and funding.¶
A.
The council shall provide the commission with staff and funding as reasonably necessary to properly discharge its function. In no event shall the council use control of commission funding to impair the independence or impartiality of the commission.
B.
Commissioners shall receive compensation for their attendance at meetings equal to that received by members of the planning commission.
C.
To the extent of the resources budgeted by the council, the commission shall have authority to select its own part-time clerical staff and, for matters pertaining to grievances and discipline, legal counsel.
